I just learned that my uncle, a decorated ex-Special Forces member, has been locked up for a little over a month...and he has STILL been denied a lawyer!
My uncle began dating a Public Defender in a little town in S.C. She gave him her key, and he occassionally spent the night with her. He found out, though, that she had an alcohol problem, drinking a bottle of wine a night, I guess to get over the contents of her day pertaining to her job. As a result, my uncle started to pull away. She filed a restraining order against him, then called him that night - asking him to spend the night. He did, knowing nothing of the restraining order.
The next day, he was served with the papers. He called her to find out what was going on - they discussed it - he agreed things were over. She calls him several nights later - they talk for a bit, he goes over as requested, they sleep together. The next day he drops by the court house to talk to a buddy (a Court Officer, as he used to be on the police force). He peeks in the window to see if his buddy is on duty, sees the Defender - the girl he had still been sleeping with (stupidly), turns and starts to leave because he is aware of the restraining order......
Unfortunately the judge, who signed the order, sees him through the window...and has him picked up for 1) disturbing her court [WTF?] and 2] Breaking the restraining order.
My uncle had started his own business - his own mortgage company, which had collapsed after being squeezed by the big well-established companies. Now he did not have any money for an attorney, so he requested a Public Defender. He was informed that the Public Defender's Office would not provide a lawyer because it was a 'Conflict of Interest' since the 'victim' was one of their own. So, the judge threw him in jail, declaring that she did not have to provide a lawyer to someone who broke her restraining order! [WTF?]
None of my family coul afford a lawyer for him, but my mom began inquiring through state agencies about how they could get away with it. The judge found out and has threatened to file separate stalking charges, breaking and entering charges, etc on him after his 90 days in jail for the restrainging order violation if any more 'trouble-making' continues!
Since he has been in, he has lost his house, lost his truck, and has been beaten up in jail (attacked by several guys while the guards watched). He lost the use in 1 eye years ago, but, as a result of one of the attacks in jail, he had a hemorage in the good eye which cause excessive internal bleeding in the eye - they refused to take him to a doctor but were forced to when another guard (one of his ex-cop buddies) saw him and took him to see one. They are not sure if he will lose the sight in his lone good eye or not! And he STILL has NO LAWYER!
:shock: WTF, man?! Is it only backwoods, Bu-Fu-Egypt, Redneck-ville, S.C. or what?! Can you believe that!? I just pay to God he can get some kind of help and that once he gets out he sues the CR@P out of the judge, the Defender, the jail, and the freakin' city! These crooked, back-water SOBs need to pay!
