As far as I know, none have been specifically charged, but all are labelled 'War Criminals' by the Feds.
Also, AFAIK, none have even been tried, let alone convicted, (this applies to most, if not all, of those already released, I've read there was once 700 inmates.) The lack of due process @ Gitmo is one of my main points here.

One must remember this "War Criminal" Military justice system was set up by the Bush Administration.....To date they have tried 3 "war criminals" and basically lost all 3 cases..............In the same time period the Federal Courts of mainland USA has tried 300+ terrorist cases and won 96% of them.................and has jailed the same in the USA with little worry..............and done so at the savings of several billions of dollars less than the Bush model.................
But then that was to be expected............

The whole affairs a stinking mess, and Obama's not "looking good" by this point, it is way too late, too much damage has been done. He still needs to end the program, but it should have been done long ago. The system never was trustworthy, many of the prisoners were abducted (renditioned) off city streets the world over. People were paid to turn someone in. That's always fraught with potential for abuse.
Apparently, Obama is willing to ignore the obvious, and very real dangers of releasing Gitmo detainees simply to honor his promise to close Gitmo. There are currently 103 Detainees at Gitmo, and these are the worst of the bunch.
Also, Obama is still considering transferring some of these to US Prisons, even though Congress has blocked the move more than once. (Most Americans are also against this transfer.)

'Justice delayed is Justice denied'. Most of these Detainees have been held without a trial for many yrs. The US Govt. has ignored the most basic of legal concepts which have their beginnings in the Magna Carta of 1215, and the later versions of this document which influenced the early American colonists and the formation of the American Constitution in 1787.

I'm not sure why we need a prison in Cuba to feel safe. We can certainly send them to a SuperMax in the middle of Colorado or Kansas or Nevada and get the same level of security. I believe they use Cuba for the obvious reason--to keep them off US soil and away from the influence of lawyers, the press or state laws. That's why the place need to be closed, IMO.
