Obamacare ruled unconstitutional by Texas judge

And Trump tweets: "As I predicted all along, Obamacare has been struck down as an UNCONSTITUTIONAL disaster! Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions. Mitch and Nancy, get it done!"


What does he mean by that?

Republicans don't have any ideas for providing "GREAT healthcare" and protecting pre-existing conditions.

They fractured the law by undoing the mandate and now we're going to have chaos, and they have no viable ideas for how to fix it.

I think he means that Congress needs to pass a strong law to fix the OCare mess. And this time Congress ought to read it before they pass it.

Like it or not, the Democrats own OCare. Now the new Democrat led House gets a chance to fix it.

Elections have consequences.
 
Just let it go and focus on the REAL problems: the health insurance companies and Medicare/Medicaid, on coverage, premiums, and payment to the doctors and their health practices.

So, all the stuff the ACA focuses on.
 
Hmmm ... maybe it isn't open and shut. Either way.

Maybe John Roberts will come up with another creative way to save it, because he has a vested interest in it since he finessed it through almost singlehandedly the first time.

Or maybe he'll put more importance on his fatuous remark about how if the people don't like it they can vote in some politicians who will get rid of it ... and he can say, "The people have spoken and they've sentenced the ACA to death."

It's up to both Republicans and Democrats to come to a bipartisan solution that they can both agree on. It's not up to John Roberts to save Obamacare.
 
Because they spent 8 years claiming they were going to repeal it and replace it with something better. They lied, including your hero Trump who promised Universal health care paid for by the government.

Trump never promised that. He promised that all Americans would have access to health insurance. They do.
 
More of the danger of the GOP being a bunch of lying do nothing frauds who's only interest is passing tax cuts to appease their wealthy donors. That's essentially all the GOP did in their past two years of being in power.

You can just about guarantee a democratic total takover in 2020 if they take it away, millions are tired of not having health care because they can't afford it, or being denied health care because of a preexisting condition. They want to go back to the insanity? Try it, and see how the vote turns out in 2020.

No it's not. Before Obamacare the poor got free medical care. All they had to do was show up and not pay the bill and let providers write off billions of dollars. The rich of course we didn't have to worry about. As usual, the left's policies screwed the middle class.
 
There were some 100 amendments to it, many by republicans. The shenanigans on the vote was a political thing, they don't have the spine to give Obama a legacy. See, when Obama's name is in it, the right doesn't want it, even if it will do good, and it does good for many. Definitely NOt a disaster for many. Though some got squeezed, it can be fixed, but repubs don't want Obama to have a legacy. They put partisan politics above the needs of the public. One thing is certain, there is no country with pure free market health care system that provides affordable health care for all of it's citizens.

The shenanigans on the vote WAS a political thing, with Democrats pushing it through without a single Republican vote. And now it has come back to bite them in the ass.

Didn't the US Supreme Court already rule that the ACA was constitutional. Now one of trump's butt kissers has decided to give trump a diversion.

As for Mitch and Nancy being expected to get it done - Pelosi is NOT in charge of the House until next year. Mitch and Paul have had 2 years to 'get it done' .

This is just a desperate attempt to create a diversion away from the Mueller investigation. There will be MORE indictments and more trumpsters going to jail.

The clock is ticking and I am betting trump will be gone as soon as Putin and Murdoch give the say so.

And it is laughable for trump to demand Pelosi 'get it done' considering she is NOT in control of the House ....YET. The republicans have had TWO YEARS to 'get it done' and they have done as much as they have with trump's frigging wall; - ABSOLUTELY BUGGER ALL.

And here we are with Trump going 2 plus years with no end really in sight, two conservative judges on the Supreme Court with maybe a third coming in 2019, not to mention all of the conservative federal judges being put in place, tax breaks signed into law, migrants stopped at the border, and now we have Obamacare ruled unconstitutional. Do you still want the Mueller investigation to go on and on and on?
 
If you buy this judge's argument, 224 Republicans in the House and 51 Republicans in the Senate voted for exactly this outcome.

They knowingly and purposefully voted to throw 20+ million people off their insurance, brought back pre-existing conditions, bankrupt Medicare, defund community health centers, de-authorize CHIP and the Indian Health Care Improvement Act, destabilize the health care delivery system, re-open the Medicare Part D donut hole, rescind resources to produce more doctors and other care providers, and a few thousand other awful things. All, apparently, the GOP's intended effect of zeroing out the mandate penalty in their tax law, per this judge.

Sly! And horrifying.

I would rephrase that just a little bit. Democrats have long wanted to fix the Obamacare mess by keeping Obamacare in place and passing fixes. We need to totally get rid of Obamacare and start back at square one and do it right with a plan that will be acceptable to BOTH parties, not just one or the other.

The Affordable Care Act, also known as Obamacare, was struck down by a Texas judge on Friday, a move that could suddenly disrupt the health insurance status of millions of Americans. The decision comes amid a six-week open enrollment period for the program.

We knew this from day 1.

You couldn't have known it from "day 1" because this judge argued that because the 2017 tax bill eliminated the tax penalty of the health care law’s individual mandate, the mandate itself was unconstitutional. Thus, you couldn't have known in 2010 what was going to be in the 2017 tax bill. In any case, the argument is flawed.

As Cristian Farias writes in today's Times:
Except the tax bill did not invalidate the Affordable Care Act — it did away only with the penalty for not being insured. Congress left the rest of the law intact.

Instead of respecting that legislative choice, Judge O’Connor proceeded to find all the operative provisions of the A.C.A. “inseverable” from the hollowed-out individual mandate. The whole law must fall. He gave the Texas-led challengers precisely what they wanted.

This partisan, activist ruling cannot stand. If it’s not reversed by the conservative United States Court of Appeals for the Fifth Circuit, then it’s off to the Supreme Court, where all five justices who, in 2012, already determined that the Affordable Care Act was constitutional will still be there.

One of them is Chief Justice John Roberts, who made a splash last month when he appeared to rebuke Mr. Trump’s criticism of judges who don’t rule as the president likes. The president this time around is rejoicing over Obamacare’s apparent demise — and is heaping praise on the “highly respected judge” who was itching to do Republicans’ bidding. (The White House, in a modicum of decency, has said the law will stay put as the appeal moves through the courts.)

But as Chief Justice Roberts said when he cast the decisive vote that upheld Obamacare, “It is not our job to protect the people from the consequences of their political choices.” Here the American people, through their elected representatives, made their choice, both in 2010 and 2017: Obamacare is the law of the land. It will remain that way.


The real lesson of the Texas Obamacare ruling is that movement conservatism, by stuffing every institution it can with apparatchiks, is corroding our political system to the point of collapse.

LOL. Over 1000 Democrats got booted out of office and Replaced with Republicans over the last several years, largely due to Obamacare's unpopularity, culminating in a Republican president, House, and Senate, not to mention 2/3 of the states.

Everyone has to be covered. We'll make a deal with hospitals and the government will pay for it.

Your introduction of the word "access," which is never uttered, to pretend Trump didn't say what he did is the very definition of putting words in his mouth. "I am going to take care of everybody" is what he said. No mealy mouthed nonsense about access to insurance.
