Same-sex spouses forced to pay high New York estate taxes upon the death of their partner will get refunds from the state.

Gov. Andrew Cuomo said Tuesday that the refunds are being issued as a result of the recent U.S. Supreme Court decision that struck down part of the Defense of Marriage Act, also known as DOMA.

In declaring the section unconstitutional, the court granted gay couples the same rights to assets and lower tax costs under estate tax laws that are provided to couples in traditional marriages. Same-sex spouses may have been required to pay thousands of dollars more in New York estate taxes when their partner died.

The estate tax issue is just one example of where bigotry by evangelicals had real life impact for same sex couples. They may talk all the time about their personal beliefs but ultimately...they are messing with peoples lives.

Shouldn't they just not have the ridiculously high estate tax in the first place? Married folk wrote so much BS into laws to subsidize their habits and property through everyone else, we should end it all. What's good for the goose is good for the gander.
 

This is the correct move, but I have to say it seems like a big to-do about very little. Does anyone have any figures on just how many people and how much money this involves? I can't imagine that between June 2011 when NY passed its SSM law and June 2013 when the SC overturn DOMA that thousands of gays married and died and paid gazillions in taxes. And if NY is going to honor SSMs that took place before NY made them legal themselves, if I was a NY taxpayer myself I might be pretty ticked that Andrew Cuomo is using my tax dollars to further his ambitions for the White House.

Well until the laws are changed so ALL in the top 1% pay the same rate as a wage earner does I still say equal treatment under the law- which apparently is really a progressive concept. (you seem fixated on the 'conservative' whine that progressives should hate the top 1% so much we want to hurt any part we can, even if it unequal) (I'd say we should hate them all equally... :lol: )

That's what I was thinking. Homosexuals have only been allowed to marry since 2011 there, so how many homosexuals would have married and died? It's easy to be magnanimous and some nice press over it when it doesn't really cost you anything. :) Smart for New York. Frankly, they should have been doing the right thing on state property taxes, all along. They made homosexual marriages legal marriages, so they should have sorted out their state taxes as part of that. They should be getting slapped around a bit because they didn't.

Yep, publicity stunt. DOMA affected federal taxs and other beneifits. It had no impact on state taxs. So, effectively why and when NEw York decided to reverse it's position on the estate tax for homosexual couples had nothing to do with DOMA, in reality.

You don't seem to grasp the concept. Let me break it down for you. I'll try to use small words so you can understand this time. The taxes they say they are "refunding" are STATE taxes for inheritance. DOMA has nothing to do with it. Their state law made homosexual marriage legal so if they weren't treating homosexual couples just like everyone else, that was bad on them. If this schtick of theirs even applies to a to anyone. It's not so much a "bad" thing as it is a stupid thing.

Almost. It's stupid because if they ever taxed homosexuals married under their laws different than anyone else it's because they had their head up their asses, not because of federal law. It's an admission of stupidity.
