"The Eastman memo laid out a six-step plan for Pence to overturn the election for Trump, which included throwing out the results in seven states because they allegedly had competing electors. In fact, no state had actually put forward an alternate slate of electors -- there were merely Trump allies claiming without any authority to be electors.

Under Eastman's scheme, Pence would have declared Trump the winner with more Electoral College votes after the seven states were thrown out, at 232 votes to 222. Anticipating "howls" from Democrats protesting the overturning of the election, the memo proposes, Pence would instead say that no candidate had reached 270 votes in the Electoral College. That would throw the election to the House of Representatives, where each state would get one vote. Since Republicans controlled 26 state delegations, a majority could vote for Trump to win the election.

"The main thing here is that Pence should do this without asking for permission -- either from a vote of the joint session or from the Court," Eastman wrote. "The fact is that the Constitution assigns this power to the Vice President as the ultimate arbiter. We should take all of our actions with that in mind." ...When Pence refused to intervene, Trump turned on his vice president, attacking him on Twitter even as the insurrection at the Capitol was unfolding on January 6."

It seems like the Republican legislators in key states have set up a system for competing electors. All it takes now is a VP and president as corrupt as Trump to play it out. And then it's lights out for democracy in America. But then, we aren't really a democracy anyway, right conservative friends?

There's a possibility of a Republican/Trump 'takeover' of the federal legislature in 2022 and, perhaps, the White House in addition in 2024. What will happen to the democratic institutions of the US in that eventuality will depend upon just how far right the US Supreme Court will actually have gone. Court 'packing' to drive it further to the right will be a possibility, of course.

The reaction from Democrats (not conservatives, of course, because **** democracy), is described as “howls.” Even in a private memo they can’t resist putting everything in the context of liberal tears.

It didn’t really rest with Pence. Not enough, at least. Too many red states didn’t have the stomach to overturn their own electorates, though in 2022 and 2024 you can bet they’ll have fortified themselves for that. Honestly, they probably already are. When red states appoint their own electors and go against the will of the voters, every single conservative-leaning voter here will adopt the attitude of “*Sniff*...what are you going to do? We’re a republic, not a democracy.”

I really don’t know how you move forward when one party has given up on democracy.

I think they have some as yet untold insights into the end of the Trump presidency and they are very frightening. The actions of Trump are frightening not only because of how serious his desire to seize extra-constitutional power were, but because of how unbalanced he was. His actions, not the opinions of others, detail his unbalanced state on January 5; Bob Woodward, a keen observer of Watergate, compares these to Richard Nixon's wandering the halls of the White House talking to portraits of former presidents.
