McDonald's customer accused of putting soda in water cup charged with robbery

That is exactly why I think the kid needs to be slapped down hard. He put getting away with petty theft above the life and well being of another human being, no one was critically injured this time but the kid could really hurt someone next time. That was a stupid and dangerous decision that needs a solid consequence.

yes it's definitely time for some tough love that will teach him there are other human beings on the planet besides him...IF he is lucky, this could be the best thing that happened to him resulting in him turning in to a decent, caring human being.

Laws are not written for individual cases. This individual is facing very serious time, as he should. Besides why subject the shelter residents to this jerk?

yes laws aren't but fortunately, we have the spirit of the law as well as the black and white which does not always serve us well

I guess because I am fiscally conservative but have a deep understanding of human psychology I am therefore game for what would work the best for society and for him to be a better human being...to me it is not about revenge, it is about fixing things...for me the simple solution is usually the best solution

I would be fine with community service...serving up food in a shelter for 8 hours a week for x-number of months would be an awesome experience for this little s**t. No car privileges during that time except for any benefiting the community.

When the first rioters from the Vancouver 2010 riots came to court, "justice" had already been done. The police, rather cleverly, posted every video they could get by law or by force of the rioters in action. They were mostly 'privileged' and pampered from wealthy neighborhoods....but the backlash against them was enormous. An up and coming model had her career ended forever, a few lost their jobs, society basically shunned them.

A few commented that they would have preferred a few months in jail to what they got. We can find better answers than jail

yes, better, more effective, and with less cost...jail should be a last resort it costs society way too much...tribal justice works best for certain crimes

Ah, then I mistakenly confused you with another member.

We had a loss-prevention specialist open a thread for a Q & A session. It started pretty interestingly, but only a few took him up on the offer.
No worries. I think if a person has the means then obviously it's better than facing charges. People who went in to steal without the money to back up the theft obviously don't have that choice which is why those numbers would make sense as a rare occasion.

He was charged with the felony of robbery. The theft of the soda became a robbery when force was used. The theft is part of robbery. Without the theft it would be aggravated assault.

WAY TO BEAT AROUND THE BUSH ! :lamo

Escalation:

- If they were eating inside and filled their water cup with soda I'd say this is an over-reaction.

- Purchasing thru the drive-thru then parking and going in does indicate planning and forethought. Not felony level, but certainly not an infraction, either.

- Assault with a vehicle changes everything, IMO. Given that fact, I'm ok with a felony charge in this case.

Why is he being charged, we have millions of ILLEGAL immigrants that aren't being charged for breaking the laws. Do we just pick the laws we want to enforce?
Just wondering.

So legal citizen should be allowed to run over whomever they please with no consequences because of illegal immigration? Is that seriously your argument?

Ask President Obama your question. Seems his administration is good at selective enforcement.

Greetings, CJ. :2wave:

The interesting part of this event is that they took the time to think up this scam to get a soda for free while driving around using gas they had to pay for! Kinda stupid thinking, IMO..............

Not if the parents are paying for the car and gas.

Yes, we do disagree, and that's quite healthy, from my perspective.

I would say, however, that there is a significant difference between what actually happened and how you are portraying it. This isn't a case of a teen just happening to walk out of a restaurant without paying for a soda. It's a case of a teen who purposely went to steal the soda from the restaurant and when caught stealing and had the chance to leave without stealing, chose to continue the theft. Many people who are caught in the act of stealing things are given the benefit of the doubt if they fess up to stealing and/or give back what they stole and apologize for their actions. This young man did neither and so he's left with the courts deciding what his punishment should be. And really, at 18, he can't cop a plea that he was drunk or under the influence of drugs, because both of those are illegal for him at his age. Courts have discretion and maybe the judge hearing his case will show leniency. Or, before it gets that far, this young man will agree to some community service and some other restitution to the restaurant or the community at large and the charges will be dropped. But until that time, the charges seem perfectly reasonable to me, under the circumstances.

The theft seems like a teenager being stupid, but the vehicular violence has to be dealt with.

I wonder if stealing soda was a perpetual crime with this McDs? After this incident, it probably will be.

Sidenote: Now would be the time for McDs not to issue anymore cups for water. To enforce the law, another right is taken away...

If someone tried to fill their own cup with soda, at least that would be premeditated.

A McDonald's on the Massachusetts Turnpike insisted on charging me the price of a soda for a cup of water. I promptly told them to cancel the entire $25+ order when it was about half bagged.

McDs knew some soda would be stolen when they did the cost/benefit analysis of replacing soda jerks with self-serve drink stations. They're way ahead at this point. My guess they are none too happy about one of their managers physically blocking someone's car and risking injury and work-comp claims for 5 cents of product that was stolen. But people feel it's justified to kill someone stealing stuff from them so it's not surprising someone would risk injury to stop something that was "wrong" despite the triviality of it.

I'm waiting for the counter suit against McDs for enticing the perp to steal from them.

I feel a little bad about this, but this entire story was so sad and ridiculous, that all I could imagine after absorbing the information was Judge Willy Wonka sentencing the young man in the court for his robbery by saying...

"You stole Fizzy Lifting drinks. You bumped into a manager, that must be washed and sterilized, so you get 20! You lose! Good day, sir!"

I suppose that reflects negatively on my empathy... or perhaps just shows that my fiancé might love Willie Wonka & the Chocolate Factory a little too much.
