Marine Names Murtha in Defamation Suit

So Navy Pride will be happy to know that one of the Marines who Murtha said was part of a unit that intentionally killed Iraqis has sued Murtha for defamation of character.

I am interested to see where this goes. Murtha was clearly not speaking during legislative proceedings, so such statements would not be protected under the "speech or debate" rule.

A Marine Corps staff sergeant who led the squad accused of killing two dozen civilians in Haditha, Iraq, will file a lawsuit today in federal court in Washington claiming that Rep. John P. Murtha (D-Pa.) defamed him when the congressman made public comments about the incident earlier this year.

Attorneys for Frank D. Wuterich, 26, argue in court papers that Murtha tarnished the Marine's reputation by telling news organizations in May that the Marine unit cracked after a roadside bomb killed one of its members and that the troops "killed innocent civilians in cold blood." Murtha also said repeatedly that the incident was covered up. . .

Zaid said the filing is designed partly to force Murtha to disclose what information he received from the Defense Department and the Marine Corps commandant to form his opinion, essentially trying to speed up the discovery process in a potential criminal trial.

"This case is not about money; it's about clearing Frank Wuterich's name, and part of that is to identify where these leaks are coming from," Zaid said in an interview. "Congressman Murtha has created this atmosphere that has already concluded guilt. He's created this environment that really smells, and he's the only one who has done that." . . .

Also, according to today's news, it looks like our boys may be in some deep do-do over that Haditha crap too. The news sure ain't gonna help his lawsuit none. And maybe ol' Murtha might have known what he was talking about after all... imagine that....:roll:

Still......innocent until proven guilty. Our troops deserve the benefit of the doubt for sure. But it ain't lookin' too good for them. :(

I don't care if your buddy Murtha knew or not he should keep his mouth shut and not say they are guilty of murder before they are even charged.......

he's sueing over the fact that after he raped the **** out of some chick then he and his buddies blew there brains all over their village...

he's not going to get that warm of a reception back home now that they know about it :roll:

What would be the reason for leaking information in this case?

I'm not sure what the Criminal Investigative Unit's protocol is, but if they have only completed the initial investigation, it would far to early for anyone to draw any conclusions. Frankly without bodies or corroborating testimony, I would think it would very difficult for them to get a conviction.

I hope the marine is successful in suing Buddy ****er Murtha.Nothing worse than a buddy ****er screwing his fellow marines/soldiers.These policitians should learn not to tarnish the repuatations of our maines and soldiers in a time of war just to win a few votes by some degenerate antiwar scum who hate our country..

WHAT? The Pentagon just determined that these people were murdered. Sorry, jamesrage, but "truth" is always a defense to defamation. It looks like what Murtha said was TRUE. So if it is true, the only people who tarnished the reputations of our Marines is THEM.
 
It's amazing how quickly the Republicans attack a democrat but seem totally at a loss in defending Bush's policies.

Of course Murtha had the whole story. This is just more of the smear campaign by Rove. He was successful in using the lies against McCain in his bid for Republican nomination in 2000. The man, Rove, is a walking gossip columnist. Nothing better to do but lies about others.

How about the real issue...what do you think of our commander in chief allowing these acts of rape and murder against innocent women to occur in Iraq? He is the commander in chief...the buck stops with him...shouldn't the marine sue Bush for allowing it? Wonder if Bush will be subpoenaed for his policies?

Jack Murtha goes to visit injured troops in hospitals every week, quietly, without publicity to express his true feelings for our military. You know $hit regarding Iraq as do I so how about you take your "Daddy" comments to yourself...unless you enjoy playing the village idiot.

Thats friggin brilliant. Exactly when did he send the comands for this to happen. Please show me some type of source saying the president ordered our soldiers to murder and rape anyone, if it has happened at all. They will remain innocent until proven giulty as far as I am concerned. But to attempt to place your pathetic hatred of the president on this doorstep is just silly. Who could possibly be ridiculous as to think the president is personally responsible for the actions of every single soldier... Does your boss get in trouble if you kill someone... :roll: :roll:

Not that I can't accuse them of what I think is pretty obvious. Doesn't matter, just like what I thought about, say, OJ Simpson. I wouldn't be suprised if these troops are let off the hook like him, except now it'll be all the conservatives cheering the failings of our justice system.

I am a Conservative and if these soldiers are tried and convicted they should be punished to the full extent of the law..........So much for cheering the failings of the justice system huh....:roll:
