Of course it will be appealed, and they will win. Presidents are allowed to make appointments without Senate confirmation if the Senate is in recess. The unconfirmed appointment may remain in that position for the duration of the Session of Congress, before they must either be confirmed by the Senate or vacate the seat. The 116th Session of Congress started January 3, 2019 and will not end until January 3, 2021. When William Pendley was appointed director in August 2019 the Senate was in recess.

Article II, Section 2, Clause 3 of the US Constitution:
The President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session.

This means that William Pendley may constitutionally hold the position until January 3, 2021. If he is not confirmed by the Senate before that date, then he must give up that position.

They did not give up on racism they just slowly started exploiting it from the opposite direction. Trading “White Supremacy” for “Identity Politics”, the KKK for Race Baiters and Groups like BLM.

Agreed. I'm certainly not buying their phony bill of goods. Obama was a far better President than Trump could ever be. And I don't recall former President Obama ever stating "get rid of the ballots" as a WH action.

You are mistaken, I did read the CNN article and they got it wrong - as usual.

The Senate was only in session for the first two days in August 2019. Pendley was appointed deputy director of the Bureau of Land Management on July 29, 2019 - which did not require Senate confirmation. The Senate then recessed August 2, 2019 and would not come back into session until September after Labor Day. Meanwhile Pendley was appointed Acting Director of the BLM on August 15, 2019, while the Senate was in recess. If the Senate had been in session, then Pendley would have required Senate approval before taking the position. However, the Senate was not in session when the appointment was made.

Because it was a recess appointment Pendley can constitutionally hold the position until the end of the session (January 3, 2021). If he is not confirmed by the Senate before the end of the Session he must vacate the position.
