There are 1001 anecdotes. But the fact is that people employ people that do it better compared to the price they demand.

If a company gets caught in this practice they should be fined and lose the privilege to use H1-B's.

Actually, it is often not because they do it better. Rather they do it for less. I can't tell you the amount of crap that gets oursourced to India and other nations in software development. They then have a single American going through it at all hours of the day fixing the problems because they would rather hire outsourced labor than do it right the first time.

Better and the amount one is willing to pay set a trade-off along which one decides to contract. The rational thing to do is look at the offers along the trade-off frontier and choose the one most compatible with one's goals. That will not necessarily be the cheapest nor necessarily the one of highest quality fulfillment. Think about employing a person to clean your house.

Meanwhile, Mar-A-Lago sought more than 500 visas for foreign workers. (The visas were also sought at some of his other properties.) We don’t know how many people actually used the visas and became employees. A spokesman for the State Department said that information is kept confidential.

So how about we take 50 people from India and who can ever do your job as well as you for the cheapest gets your job?
