A federal district judge in Indiana has once again ordered the state Department of Correction (IDOC) to arrange a sex reassignment surgery for a transgender inmate convicted of reckless homicide of a baby, marking the latest development in the ongoing legal saga challenging an Indiana law banning the procedure.

The case, now in its second year, involves inmate Autumn Cordellioné's request for sex reassignment surgery. The American Civil Liberties Union (ACLU) first filed the lawsuit against the Indiana Department of Corrections in 2023 on behalf of Cordellioné, challenging an Indiana law that prohibits the Department of Corrections from using taxpayer funds to cover sex reassignment surgeries for inmates. The ACLU argues the law is a violation of the Eighth Amendment’s prohibition of "cruel and unusual punishment."

Under what law does a person have not only a right to sexual reassignment surgery, but that the State using taxpayer money has to both arrange for and pay for such surgery?

IMO the ACLU (an organization I once upon a time fully supported) is now full of crap.

I bet if it gets to SCOTUS (which it may if the ruling is not smacked down by the Appellate Division) it is likely to be overturned.

Sorry, this has "F***ed up written all over it. This is a complete clusterf***. In my world, surgeries like this shouldn't even be available to anyone incarcerated in a penal system. Especially if it's funded by taxpayers. I'm not anti-trans, or anti-gay, but sorry, the only surgeries that should be approved for an inmate paid by taxpayers should be life saving surgeries.
 
I'm a long time member of the ACLU and I support this decision. Unless you can prove that this is a jailhouse conversion with alter motives then she deserves to get the medical care she seeks. We all have equal rights, and not just the people you agree with.
 
Look, I will say that sex reassignment surgery does not strike me as something that is medically necessary in many cases, and therefore is not something the government should generally be required to provide to inmates. But I am not a medical expert, and court cases like this one turn on expert testimony and the particular facts of the case. Here is the court opinion, which details the expert evidence from both sides and the plaintiff's long history of suicide attempts and other destructive behavior stemming, allegedly, from her gender dysphoria.

I'm sure the usual suspects on here will just say she is mentally disturbed and the government doesn't have to humor crazy people with elective procedures. But even accepting that premise, it can be cruel and inhumane to deny a person with a mental disorder the type of care that might alleviate the most destructive of their psychological symptoms, or ultimately be the difference between life and death. You wouldn't say, for example, that a person with severe anxiety disorder should be denied drugs because they have a mental rather than physical disorder. The court opinion suggests that many other treatment options were tried and failed. It also suggests that the government failed to sufficiently counter ACLU Indiana's expert evidence on the medical necessity of these procedures in some cases. I wouldn't be surprised if this was overturned on appeal, and I wouldn't even think that was necessarily incorrect, but this may be one of those issues that with time and greater scientific research eventually gains greater acceptance.
 
Ever since Chase Strangio's hostile takeover of the ACLU, it has reoriented itself as an illiberal trans advocacy group instead of a liberal civil-rights advocacy group. It's basically a totally different organization that happens to bear the name of its predecessor.

I don't think "Murder a child to get a free boob job" is a very good incentive structure or a viable policy.

This is like a perfect storm of all the things conservatives complain about leftists: Coddling criminals, wasting taxpayer money, performative wokeness, and ridiculous levels of deference to trans activists. All rolled up in a single event, handmade for Republican campaign ads.

The ACLU isn’t my favorite organization, but they have historically taken the side of civil rights even when it isn’t necessarily popular.

Sadly, the ACLU is a shell of its former self. I don't even regard it as the same organization it was in previous decades...just a new organization that shares the same name.

Necessary medical care is not a privlidge to be earned. Transgender care is not plastic surgery. That claim was rejected by the courts in the late 1990s.

Ive been a member since 1991 and I had to google his name because I had never heard of his. His only specialty is LGBT rights. He isn't the top lawyer.

A boob job is not in any way, shape, or form, "necessary medical care" akin to cancer treatment.
