Yes he can. The judge didn't say the question is unconstitutional; in fact he said it is constitutional. The judge ruled, wrongly, that the government didn't follow the proper procedure in adding the question.

So a Democrat shopped federal judge ordered that there is a reward to providing sanctuary to illegal migrants and a reward to non-citizens by giving them equal Congressional representation. No surprise about that.

It's a shame Americans lost the Revolutionary War because then we would not have a judiciary that operates under British common law rather than the American Constitution.

All but 2 census asked about citizenship. Democrat Bill Clinton eliminated it for 2000 and Democrat Barrack Obama kept it off in 2010. Democrats want Congressional representation based upon counting illegal migrants and non-citizens.
