So here is a question for you. My friends house was broken into and they picked the keys up off the kitchen counter and also took his car. Is he responsible for them stealing his car because he left the keys on the counter?
From what I heard, they didn't necessarily purposely put their photos on the internet. Being ignorant of how Apple's iCloud works they took naked photos and their software automatically uploads them to the Cloud, where hackers had access to it. If someone takes nude photos with other software it's not going to be accessible by others.
You have to take human nature into account.
Sure, legally and ethically....the thief was responsible.
But she is also indirectly responsible by making her photos available.
Those photos could not have been stolen from the Cloud had she not put them there.
So, like it or not, she is partially responsible.

Personally I can't believe the number of people that claim it's the owner of the photographs fault for taking them in the 1st place. They have a right to privacy.

the person that hacked into a private account to steal the photo is at fault. It isn't open to debate. those that said otherwise are morally bankrupt

Agreed. The person who owns the photos should, as a practical necessity, protect them self from hacking, but any shortcoming on their part should never ever be used to justify or condone or rationalize stealing/hacking.The person who did the hacking is responsible. Blaming the people who photographed themselves is like blaming someone who bought gold instead of the person who broke into the safe and stole the gold.

I did say that whoever hacked and leaked the photo is a fault and should be charged. Let me explain it this way. Let's say that you have 1 million dollars. Wouldn't you keep it in a safe and have that money super protected? I think anyone who has a reasonable mind would. Now let's say that you leave it on your kitchen table and you got to the store or somewhere. A person then breaks into your house and sees the money and takes it. Now that person whole stole is at fault and should go to jail. Now I think if the person wanted to keep that money absolutely safe they would protect it a little more. And everyone would call you an idiot for leaving the money out on the table. So both are at fault but the person who did wrong in the first place was the owner of the money.

I have an iPhone and I may have it backing up to the cloud (I don't think so, but maybe) but I also know that since I can connect to the internet over the phone I figure that the internet can also connect to my phone. For that reason I don't have any personal stuff on my phone. If someone wants to hack my high score on Soduko or see pics of my back yard I'm not going to be too pissed. If, however, they want to see pics of me naked they're going to have to get pretty damned creative because even if I was brazen enough to do something like that it damned sure wouldn't be on my phone.
I'll remember to tell that to tell the next person who robs me...

Well sure he is. Nowadays you have to take every precaution possible to protect things inside your house. In my opinion there needed to be an option called "both are at fault" because that's the truth.
