Actually the D did come up with proof. We saw it in the House impeachment hearings. We also saw the tacit admission of guilt when Trump blocked everyone in the know from testifying. Then, we really saw obstruction in action when all the evidence was squashed by McConnell in the Senate..

There is one problem with your thinking. When you go to the court of appeals you can't present NEW evidence you have to use the evidence you had in front of the first court, because you are saying it should have been ruled in your favor because of the evidence you put in front of the first court,
IF you do find new evidence then you would have to file a new case

Appeals courts only rule on evidence presented at trial courts. How exactly do you think Powell will be able to introduce this evidence on appeal?

Clearly stated here is that you have no idea what you are talking about regarding the appeal process. Evidence is presented in district court. Appeal court is there to appeal rulings, not present evidence.

I watched the Florida vs Vanderbilt football game. With less than 2 minutes left and the Gators having the ball, the Gators were so far ahead it was impossible for Vanderbilt to win.

It is understood in football in just one play a player can be crippled for life in contact sports. Yet do you know what the purely evil, immoral Vanderbilt coach did - and those team players did? THEY REFUSED TO CONCEDE!!!! They should be thrown out of the league for literally endangering people's lives ONLY because they refused to concede even though it was impossible for them to win.

Any team that will not concede when it is clear they can no longer win who does not concede should be thrown out of the league and any coach or player who continues to play after certain defeat should be banned from all future competitions. I am certain at least 95% of Democrats on this forum agree.

Yes you are correct. Appeals are based only on legal issues.

Her case will have to go before a district court first and she has to present what she has there. Her evidence does not have to prove beyond a shadow of a doubt that crimes were committed but it needs to be compelling enough for the judge to hear the case. If the judge refuses then she has the right to appeal.
