Is NSA Spying Violation of 4th Amendment and US Constitution?

I decided to start a poll on the revelation of NSA spying activities without court approval. Is this a violation of the Constitution? Specifically the 4th Amendment? Make your case why or why not this is a violation of the Constitution, the 4th amendment.

I am wondering if some organization will try to sue based on the premise that NSA spying is a violation of the 4th amendment.

Bush mentioned in his address that only calls placed from a foreign country to the US are monitored without court order or from the US to a foreign country. Technically, it doesn't appear that this is a violation of the 4th amendment, but Mr. Bush is certainly pushing the constitution to it's limits. This action that Bush has decided to take certainly does justify not extending the "Patriot" Act because government has demonstrated that it will take as much power and use it to the fullest extent possible through technicalities in the law to curb freedom and civil liberties.
