The job of the SC is do their best to interpret the constitution.

Public opinion should not be a consideration. If the issue is that important its up to the people to cajole their elected reps to either pass laws or amend the constitution.
 
Enough that people don't start ignoring the court or electing politicians who will ignore the court.

The law should matter, but that is not what these right wing hacks are basing it on. THey were unqualified choicse and chosen for one thing, to rule in favor of the right and waht the right wants, facts be damned. Their rulings are very lacking in actually making sound legal arguments.

Public opinion only matters in that republicans voting base of moronic scum were ok with putting in unqualified hacks onto the court while they projected and whined about politicizing the courts. Dem picks are highly qualified and rated. Rep picks are rating poorly and are put on to push republican taliban bullshit.
 
Our laws only really matter if there is willingness among the vast majority of the public to go along with them. The same can be said for our institutions. So yes, public support for the rights of women to make decisions about their own reproductive health should definitely be considered. Unless conservative America is fully prepared to start locking up hundreds of thousands of women yearly and charging them with murder.

You need to realize how wrong you are. That you are buying into the theoretical but essentially irrelevant idea of how it functions.

And that simple issue hurts understanding the situation. It repeats the illusion and keeps people from understanding.

What the Supreme Court actually is today - as Sheldon Whitehouse has explained in his series "The Scheme" - is a power center with powerful interests who want to control it, and so they invest billions of dollars to do so - in grooming lawyers who will serve as justices following their wishes, in getting politicians who will vote for those select justices, and in getting those lawyers selected and confirmed.

That's it. And the public needs to understands that's what it actually is. And every time someone repeats the 'theoretical' idea of 'do their best to interpret the constitution', without clarifying that's phony and the above info, they are repeating a lie that pushes people to have a wrong idea about it.

The Supreme Court is now a political branch. Who is elected determines whether one 'side' gets to appoint 'their' judges to follow their agenda, or the other side that actually does what you describe gets to appoint theirs, and they actually do what you say they should. Now, I know you MEANT to say 'that's what it should be' and weren't denying the problems, but consider what I said and how you left all that out.

No, but they should be basing their decisions on the constitution and not on their politics or their religion as the cons on the court are now doing. That is why a majority of Americans no longer trust the court and even think it is now just political.

If you think its been recently that he supreme court has been basing their decisions on their personal beliefs then you have been living under a rock these past several decades. Liberal justices making rulings based on their liberal beliefs and conservative justices make their rulings base on conservative beliefs. When it comes to guns,abortions, unions, illegal immigration and many other issues I know how all of Obama's and Biden's supreme court judges are going to rule.

The Constitution is a framework. Within that framework, justices are given power via precedent to make decisions.

These decisions should not be influenced by the weather of the day, but they should be influenced by the climate of the era. Otherwise the Court is going to be so out-of-touch with society as to render itself illegitimate in the eyes of many citizens.
 
Public opinion officially means nothing to the Supreme Court. They're appointed for life.

On the other hand, now 5 of the justices get a very special mention in the history books, and it's not going to go the way they think it is.
