Democrats on the House Judiciary Committee are calling for an emergency hearing after Attorney General Jeff Sessions announced he was resigning at President Trump's request on Wednesday.

House Judiciary Democrats are demanding answers for Sessions's ousting in letters written to the panel's GOP chairman and Sessions's replacement, Acting Attorney General Matthew Whitaker, respectively.

Rep. Jerrold Nadler (D-N.Y.) and other Democrats pressed Whitaker, who was Trump's pick to serve as acting attorney general, and Chairman Bob Goodlatte (R-Va.) on Thursday about how the shake-up at the highest levels of the Justice Department (DOJ) will impact special counsel Robert Mueller's investigation.

In their letter to Whitaker, the Democrats warned that a "constitutional crisis" could ensue if the Mueller probe is not protected, urging the new top cop to recuse himself and place Deputy Attorney General Rod Rosenstein back in the supervisory role for the probe.

“There is little doubt that President Trump’s decision to force the firing of Attorney General Sessions places Special Counsel Mueller’s inquiry at grave risk,” Democrats' letter to Whitaker reads.

Whitaker’s sudden elevation this week to replace fired Attorney General Jeff Sessions has put new scrutiny on his involvement with the shuttered company, whose advisory board he joined in 2014, shortly after making a failed run for U.S. Senate in Iowa.

George Conway's piece on why the Whitaker AG appointment is unconstitutional is very good.

Anyone that can't see this as anything more than a blatant power grab is blind. Trump didn't want his power grab to affect the midterms which is why he waited until after.

I believe you meant "ousting" in your thread title. If not you really do have a scoop.
BTW, last year the Democratics called for Sessions ousting ... but now it's a scandal.

Being forced to leave is 'ousting', being given no other choice but to resign is being 'forced'. You're comparing apples to apples and they're exactly the same thing. My thread title stands firm at 'ousting'. In 2017 the Democrats insisted that Sessions recuse, which is what he did because he had no other choice, they did not "call for Sessions ousting".

His sole argument is that it's unconstitutional if the Senate doesn't confirm.

No one, including Conway, objected to Sally Yates being appointed Acting Attorney General in 2017, and in fact, she was a hero when she ordered the Justice Department not to enforce Trump's first travel ban order. She was never confirmed by the Senate.

If it's unconstitutional in this case, it was unconstitutional then. But no one even whispered about it at the time.

Nor did they when any other Acting Attorney General was appointed temporarily without Senate confirmation.

And if his argument really held water, then 5 U.S.C. Sec. 3345(a)(3) is unconstitutional. He didn't argue that it was. In fact, he explicitly dismissed any arguments concerning that section of law.

(And people like to credit the argument entirely to Conway because he's married to Kellyanne Conway, but he wasn't the sole, or even apparently the principal, author of the piece.)

Yes Sessions recused himself because he was part of Trumps campaign, but the new AG wasn’t , so he has no obligation to recuse himself, it looks like maybe now the real criminals might get a taste of a special counsel !

This is the problem of the FBI being a part of the executive branch.

It is a flaw in our system. I don't think there is anything illegal/unconstitutional about it.... unless you think the existence of the FBI as an organization is unconstitutional.... which I think actually has some merit.

Matthew Whitaker is not in the line of succession, that and the fact that he's already vocally displayed bias against the Mueller investigation, should disqualify him from acting as interim AG and he should recuse himself.

Well of course they didn't....Didn't we see this before? Comey? They wanted Sessions in for the reason that as 'recused' he can not properly oversee the SC....Now that there may be someone who will take oversight of Rosenstien at the very least, and has the final say of what happens to any report that Muller comes up with, they are screaming foul....But, nothing unconstitutional here...
 
Trump is allowed to fire anyone he is allowed to hire.

That's why this type of unbridled power is referred to as 'the deep state' and 'the shadow government'. Whether Whitaker can or cannot serve in an interim position is still being decided, but he cannot be appointed to the position on a permanent basis with the confirmation by the Senate.

If a president could just hire or fire whomever he chose then Merrick Garland would be sitting on SC bench today.

All these people involved in criminal enterprises and mostly getting away with it because they weren't too high profile ... and then they hitch their star to Trump's wagon and think that their misdeeds won't be scrutinized?

Sally Yates was confirmed by the Senate as a DOJ officer, she was the Deputy AG. No acting AG has ever been appointed that wasn't confirmed as an officer by the Senate unless you go back to the 1860's before the current laws were even in place.

Trump's favorite Supreme Court justice Clarence Thomas agrees with this so it'd be fun for it to go to SC.

If rosenstein isn't conflicted neither is whitaker

Ah, so your problem is that he didn't name Rosenstien as acting?

If he's qualified for the position, and doesn't have a clear conflict of interest, why should having an opinion on the handling of the investigation disqualify him? Note that a clear bias for or against the subject of an investigation can create a conflict of interest, but a difference of opinion on a procedural issue doesn't.

And in this case, the only thing I've heard that he's vocalized is an interest in wrapping it up, which doesn't even indicate a bias 'for' or 'against' the investigation. With 2 1/2 years of investigation, including 1 1/2 of a special council, it's time to paint or get off the ladder.

Since advise and consent is part of the Constitution, what laws is KC talking about?

Of course he had another choice. He didn't have to recuse himself nor should he of done so, but that's all water under the bridge now.
