"According to a sheriff’s office spokesperson, Herrera was arrested after it was learned she “intentionally and knowingly cause the death of an individual by self-induced abortion.”

I'm not sure how they came up with, "individual"? Wouldn't "individual" imply post birth?

Iirc, under the Texas law, women aren't held culpable. This must be a new one they just made up.

Well, the responsible parties are the ones who performed the abortion or helped the woman obtain one. In this case she performed the abortion herself so she's responsible I guess. How crazy is that?

No. Darwin wasn't a conservative social Darwinist; Darwin was a brilliant scientist that is said to have been key in figuring out evolution.

If you're understanding evolution to be "survival of the fittest," you're misunderstanding evolution.

Some pregnant women go full nutter and kill their kids anywhere from the womb up until years later.

Some kind of defect I suspect. which, as Darwin explained, is like the crazy chicken that pecks it's own eggs.

I just made that part up.

Natural selection is the idea that species that acquire adaptations favorable for their environment will pass those adaptations to their offspring. Eventually, only individuals with those favorable adaptations will survive, which is how the species changes over time or evolves through speciation.


In the 1800s, after Darwin first published his book "On the Origin of Species," British economist Herbert Spencer used the term "survival of the fittest" in relation to Darwin's idea of natural selection as he compared Darwin's theory to an economic principle in one of his books. This interpretation of natural selection caught on, and Darwin used the phrase in a later edition of "On the Origin of Species." Darwin used the term as it was meant regarding natural selection. Nowadays, however, the term is often misunderstood when used in place of natural selection.

Sounds reasonable. I suspect that members of any given species that want to kill their offspring are probably not the fittest to adapt.

Good, I hope she is convicted. And doesn't Texas still do the death penalty for murder too?

Well, laws are there for a reason. If she willfully murdered her baby then she should suffer the full punishment.

Too many unanswered questions but this could raise some interesting legal issues. For instance, if she took an abortion inducing drug (that's the rumor) that caused the miscarriage, did she take in Mexico or in Texas? If she took it in Mexico, how can Texas charge her for something that is legal to purchase in Mexico? Will Texas be prosecuting women who get abortions in other states in the US?

All good questions. The radius of Texas’s new laws is extremely nebulous and deeply unsettling.

The problem with the law is that this actually might have been a case that would have been prosecutable by anybody’s definition a year ago. But now? When it’s just as plausible that a woman could be prosecuted for taking the morning after pill? Who can say?

Gonzalez said that while her group did not know all the details, Herrera had been allegedly in the hospital, had a miscarriage and then "divulged some information to hospital staff, who then reported her to the police.

Hospital staff ratted her out.(n)
