Liberals, stop being so defensive. That’s the message of Harvard law professor Mark Tushnet in a new post at Balkinization, titled “Abandoning Defensive Crouch Liberal Constitutionalism.” The problem, according to Tushnet, is that liberals have been too defensive when it comes to advancing their agenda in the courts.

Now that President Barack Obama has reshaped the federal judiciary, liberal causes can win easily in court. And now that Justice Antonin Scalia has died, “judges no longer have to be worried about reversal by the Supreme Court if they take aggressively liberal positions.”

Tushnet blames what he calls the “culture wars” on conservatives, and he says liberals should now make conservatives pay. “The culture wars are over; they lost, we won,” he writes in italics. Tushnet claims that conservatives “had opportunities to reach a cease fire, but rejected them in favor of a scorched earth policy.”

When I was a young boy in high school and college, I mistakenly use to think that people who went to, or taught at Harvard, were highly educated people and knew their stuff. I couldn't have been more wrong.
I didn't know back then about the extreme liberal bias and liberal agenda that factored into these people's bent mind!

When I state here often, that "liberalism transcends all rational thought, religion, politics and common sense".......I don't say that lightly. Religious persecution can be physical or mental...and this ****ing dope, is a prime example of idiocy!

To whoever asked me for some examples of religious persecution in past threads, here ya go.
 
The idea that they have won isn't exactly correct...yet. They are seemingly winning though. If they do eventually win, you will know it, because individual liberties will begin to shrink or be dropped altogether, such as the 2nd amendment.

Its hard to believe that people pay a LOT of money to have their kids brainwashed by blind ideologs like this guy. This isn't education, it's more in line with hate speech. But when progressives do it, it's never called hate speech. Why? Because the media in America don't betray their own kind........Well, most of the time anyway.

Does it bore you? I would think that anyone would be against this sort of nonsense. Do you support this type of rhetoric in our top learning institutions? I would imagine that your response would be a bit longer than just 1 word if our schools were filled with far right wing lunatics preaching hate to their students, am I right?

They were at one time. But now America's best institutions are being destroyed by leftists.
 
When conservatives win...they pretty much say, "Like it and live with it...or leave" to those who lost. Professor Tushnet is saying, "Give them a taste of their own medicine and see how they like it."

I can see that it has a bitter taste for the conservatives here.

Tough. Like it and live with it...or leave.
