GSA erred in ignoring Trump emoluments issue, IG finds

The General Services Administration improperly overlooked constitutional issues when it found President Donald Trump's D.C. hotel was in full compliance with a government lease of the historic Old Post Office in downtown D.C., according to a report released Wednesday by the agency's inspector general. The IG's report found the GSA ignored the issue of emoluments, a debate that had flared up even before the president was sworn in, when it issued a March 2017 determination letter finding Trump had taken proper steps to ensure hotel funds "will not flow to the President" while he's in office. GSA contracting officer Kevin Terry noted in his determination letter that his review was focused on Trump Old Post Office LLC's compliance with its lease of the federally owned building at 1100 Pennsylvania Ave. NW, and not whether the lease violated a constitutional clause that prevents U.S. government office-holders from accepting an emolument, or benefit, from a foreign government. The GSA's IG wrote in its report that "the decision to exclude the emoluments issue from GSA's consideration of the lease was improper because GSA, like all government agencies, has an obligation to uphold and enforce the Constitution; and because the lease, itself, requires that consideration."

Better late than never I suppose. Two Federal trial judges have ordered that separate lawsuits regarding Trump and violation of the Emoluments Clause will go forward.
