Congress can provide sentencing guidelines, but those guidelines can't be mandatory. The Judge in the case in question has to have discretion. That's why they're called "Judges".

Do you realize that it was the south that wanted every person counted and the north that didn't want slaves counted? 3/5ths was the compromise.

You need to read a little further. "Booker" say nothing about overturning/igonoring minimum sentencing.
