Not according to US v. Booker.
Congress can provide sentencing guidelines, but those guidelines can't be mandatory. The Judge in the case in question has to have discretion. That's why they're called "Judges".
Maybe, but the number of rulings she's had thrown out is telling and her reasoning behind handing out those lesser sentences is hewn with personal bias.
