well you have no proof of your claim. the fact is-even liberal scholars who liked what FDR did, noted that the FDR administration ignored the tenth amendment and essentially used political expediency to "amend" the constitution.

I did. I taught it in law school. Did you forget that case was prior to the several cases in the 1934 era that struck down New Deal legislation.

You taught in law school? I'm it refers to a subject other than law. Otherwise you'd recall the end of Article I Section 8, Or McCulloch v. Maryland.

To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.
