"Foster Farms announced Saturday that it will comply with a Merced County health department order and temporarily close one of its poultry plants in Livingston, Calif., the site of a coronavirus outbreak that has left eight workers dead.

Officials said the company did not complete the widespread testing of employees that the county first recommended and then ordered."



Kinda weird huh?

And that last sentence above, I don't know. That almost sounds like negligence.

unusual but not rare... some people may refuse to test for a variety of reasons. It's not the sole responsibility of a company .. a person's right of refusal..

That is one thing I can say about NY they have reg's and they enforce them , It is not unheard of having the state Health dept. show up at 1 AM to check and see if a bar, or rest. is complying and there have been a lot of them shut down and fined
as I said about what is going on in some of these other states you can have all the reg's you want but if you don't enforce them they are no good at all

An employee doesn't have the right to refuse to be tested on the job in this case. Under such an order, his only options are to get tested or leave the premises and don't come back until he's ready to submit to a test. If the employer didn't enforce this, then it's on them for violating the order.

well they have the right to refuse to be tested but if the States requires that a company has to test to reopen and you refuse to be tested here in NY they will tell you that you are laid off , and seeing being tested is a state requirement for them to reopen you will not get Unemployment, they have a job for you and there are requirements that have to be met and you are refusing to meet them they do not have to give you unemployment
I just saw this happen about 2 weeks ago
the person is trying to fight it but the state has ruled against him,

yup! sorta' ... up close and personal knowledge here...
actual: the SOP appears to be .. employers furlough the employee for 14 day quarantine from workplace; not specifically complete self quarantine. ,,
The employee may return to work until doing the next periodic retest... employee may again refuse.
Rinse and repeat.
speculation: with fed. EEOC regs, the employer may not be able to replace the employee who refuses the testing..
Tough spot for any business...
