A felony to record cops doing their duty, right out in public?

It's one thing to be a two-party consent state, meaning you cannot record anyone without their consent. BUT, generally speaking, if you are openly doing the filming - holding your phone out, even telling them you're doing it - and they stick around, that's considered "consent."

It'd be pretty ****ed up if this law says the cop can just order you to turn it off and if you don't that's a felony. They have repeatedly proven that they need to be filmed for justice to be served. But that's a youtube link, not an article so.... not spending more time on it.

Is it a felony to record a person who you think is committing a crime but they really weren't?

Hasn't it been ruled many times that nobody in public has an expectation of privacy?
