Does anyone think this guy deserves to be tried for murder?
I can certainly see both sides, but I wouldn't mind him being locked up for 25 years... He killed 2 people needlessly and deserves to pay for it...

I saw the video, it's pretty intense...

This guy is from my home state, Arkansas, but perhaps that says a lot...

It's completely horrible what this guy did, but I'm curious why it would be considered murder and not manslaughter as it wasn't exactly intentional.

(Note that the article did say this: The jury may also consider a conviction of second-degree manslaughter or criminally negligent homicide, which carry lesser sentences.)

I did see the part where the jury can consider convicting on lesser charges.

Perhaps in NY state, there is something in their law that can state that if someone is so reckless in committing accidental manslaughter, it can be upgraded to murder... I don't know...

Still, I'd like to see this guy go away for a long, long time...

I don't know the law in NY, but in Michigan this could be murder. Intent is a variable word. In Michigan, if a reasonable person could know that your actions could cause death, intent is proven. So, if I fire a shotgun in a crowded church and kill someone, I can be charged with murder....even if I did not actually intend to kill someone. A reasonable person would know death could result, so my actions imply intent. This seems to fall in the same category.
