Florida Sheriff: "We Prefer" Homeowners Shoot Burglars To "Save Taxpayer Money"

What he said (according to the OP link) was:

"If somebody's breaking into your house, you're more than welcome to shoot them in Santa Rosa County, and we prefer that you do actually," Johnson said.

The family of the first unarmed burglar killed on sight by the homeowner should add Johnson’s name to their wrongful death lawsuit.

(1) A person is presumed to have held a reasonable fear of imminent peril of death or great bodily harm to himself or herself or another when using or threatening to use defensive force that is intended or likely to cause death or great bodily harm to another if:

(a) The person against whom the defensive force was used or threatened was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a dwelling, residence, or occupied vehicle, or if that person had removed or was attempting to remove another against that person's will from the dwelling, residence, or occupied vehicle;  and

(b) The person who uses or threatens to use defensive force knew or had reason to believe that an unlawful and forcible entry or unlawful and forcible act was occurring or had occurred.

I live in Los Angeles.

No public official would ever give such advice.

Too bad.

If homeowners knew that the law was on their side when these horrible predators have the gall to break into one's home, they would shoot a lot more of them, and this would be a safer and happier place.

People in Florida are lucky to have stand-your-ground laws.

There are a lot of really, really, really dangerous individuals there. And here.
California law does permit homeowners to use lethal force.

198.5.

Any person using force intended or likely to cause death or great bodily injury within his or her residence shall be presumed to have held a reasonable fear of imminent peril of death or great bodily injury to self, family, or a member of the household when that force is used against another person, not a member of the family or household, who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence and the person using the force knew or had reason to believe that an unlawful and forcible entry occurred.

As used in this section, great bodily injury means a significant or substantial physical injury.

I don't get your point. You are saying they didn't take a life, I get that, but what stuff of theirs is worth taking a life?

My point is that the sheriff seems to think that the burglary victim who shot at the (alleged) perp (and missed) is not cooperating with the criminal investigation for fear that they may be prosecuted for shooting at the suspect.

"I guess they think they did something wrong, which they did not. If someone's breaking into your house, you're more than welcome to shoot them in Santa Rosa County. We prefer that you do, actually. So, whoever that was, you're not in trouble, come see us. We have a gun safety class we put on every other Saturday. If you take that, you'll shoot a lot better, and hopefully you'll save the taxpayers money."

It is clearly legal to use deadly force to stop a home invasion in FL.
