This bill, passed on 17 October of this year, was not passed in a transparent fashion, with any kind of debate, but was sneaked into a defense bill as a rider without any scrutiny at all. So what does it do? It makes substantial changes to the 200 year old Insurrection Act, and subverts just about all the Posse Comitatus statutes ever passed by Congress. In addition, it gives the Executive branch alone the power to determine who and who is not an enemy combatant, and also usurps the governors' powers of control over their own states' National Guard troops.

In the end, the language of this bill would make it easy for the Executive branch to declare martial law, and use troops against its own citizens.

Point you should note, when Martial Law is declared the troops used are always those who normally guard the people.
So perhaps you would be kind enough to explain what point you are trying to make?
 
Y'know, keeping the troops in Iraq until spring of '09 is starting to sound like a good idea.
