Federals appeals court: California ban on sales of semiautomatic weapons to persons under 21 unconstitutional

Let's see what happens when we look at the issue using actual facts:

According to the FBI's 2019 crime statistics, there were 364 murders committed in the US that year using rifles. That's ALL rifles of all kinds. They don't keep statistics for "assault rifles", but given the hundreds of millions of conventional rifles out there, it's unlikely that it's more than half. Let's call it 200 to be generous. Just to put it into perspective, there were 600 murders committed using fists. So the odds of being killed by someone punching you are three times as high as being killed with an "assault rifle".

Yet attacking "assault rifles" is a cornerstone of Democratic gun policy. "Hell, yes, we're going to take your AR-15!". Why are they making such a big deal about them if they are so rarely used in murders?

First and foremost is to generate an atmosphere of fear from which you can only be saved if you vote Democratic. You seem to have bought into it heavily.

The second reason is that the Supreme Court has declared that weapons "commonly used for lawful purposes" are protected by the Second Amendment. So-called "assault weapons" are commonly used for lawful purposes. They are also used in a very small percentage of crimes. So why are the Democrats so determined to ban them? Because they want to establish some way around the common use protection. Once they've done that, more and more guns will be classified as "assault weapons". First all semiautos. Then bolt action "sniper rifles". Etc, etc. This is entirely consistent with a long established strategy of incrementalism as manifested in Democratic anti-gun states like California.

In BUFFALO-that's NEW YORK STATE. those "mass killing machines" are illegal in NY. so is shooting people. . What laws do you want to prevent this given a life sentence apparently did not. In many countries it's not enough to be able to drive to the countryside in order to get a permit for a long gun. You also need to provide written consent from a landowner to shoot on their land if you don't have a farm yourself. It's quite unlikely that most city-dwellers in America would have access to private farm land for purchasing their AR-15s.

A rural/metropolitan split in gun legislation would partially reflect state politics in terms of New York and Los Angeles versus the agrarian and Republican interior. Having gun control in these two megacities would increase national safety even if it were to exclude other urban regions.

Let's not forget that the second amendment was written in the context of war that was predominantly fought in the countryside:

"Cities were small but powerful places during the American Revolution. Less than four percent of the 2.5 million people in mainland British North America lived in a city in 1776. Most of those cities were small. Only four had populations above 10,000 people, including Boston, New York, Philadelphia, and Charleston."

It's a stupid statement.
 
Too often the justice system is misconceived as a punishment system. Such an idea kinda half gets it. The justice system is about dealing with crime after the fact, true. It's about society being able to act in a manner, in response to a crime, so as to justify the existence of society.

But punishment is not justice. Public safety through incarceration and opportunity for redemption through rehabilitation are justice. It's not about punishment, as punishment does not justify the existence of society, it's about public safety and opportunity for redemption. If we misconstrue the system as punishment, we are one step from a cruelty system.

Generally, the primary goals of sentencing are punishment, deterrence, incapacitation, and rehabilitation. It is not a misconception. The purpose of punishment is inextricable from our system of justice to provide fair treatment to each individual.
