I'm sick of hearing this "failure on the part of the federal government" bull****. ICE doesn't have the resources to go after every single alien in this country. That's why the agency is focused on criminal aliens. Look at the secure communities program. That has shown excellent results.
States want a resolution to the illegal immigration problem. STATES are the ones left to deal with the **** because the feds WONT and SINCE the feds wont the states are. Youve heard the saying...lead...follow...or get the **** out of the way...right? The fed is so screwed they cant get out of their OWN way, let alone everyone elses. They have failed at damn near EVERYTHING. Time for them to climb into a hole and let the states do what the Fed is too incompetent to do.Because for the 10th time now, the billions they were trained with is part of a legal cooperation with 287g. They do not want to comply with 287g and are instead creating their own laws and trying to enforce immigration law. And again, it is not their job. Please review titles 8, 19, and even 50 if you'd like of the US Code. US code = enforced by federal law enforcement. And an alien just living here is not a criminal... I really don't want to get into this again. But the reason they are not prosecuted as criminals is you cannot prove the specific part of the border an alien crossed at to prove in a court of law that the alien violated 1325, which is the criminal statute, so instead civil penalties which ultimately culminate in voluntary deportation are what happens to an Alien found anywhere else other than the border (and even if they are found at the border, they are instead once again just sent back... the US attorney/federal court system cannot handle prosecuting every single alien)
But they could perhaps enforce the law against hiring illegals, and maybe even make it legal to check status when they enroll kids in school. That should cut down the numbers a bit.
But, then the feds would have to want to do something about illegal immigration, instead of merely wanting to appear to want to do something.
Again that's really hard to enforce though without more resources. You can't just drop a blanket on every single business in the country and make them prove they do not have any illegal aliens on staff. A good way to solve that problem is the current everify program, and some states are requiring employers to use e verify. I have no problem with that, though the courts may.
The feds seem to.
It seems to me that the fines would pay for the cost of enforcement. Even if they didn't, illegal immigration is costing a pile of money currently. Enforcing the law should save some of that.
Sure, it is costing a pile of money. The DREAM Act would raise revenue by up to 4 trillion in the next 40 years (http://naid.ucla.edu/uploads/4/2/1/9/4219226/no_dreamers_left_behind.pdf) , but still let's not do it, right guys?
E-verify is run by DHS, and supreme court did say states can mandate the usage of e-verify, so there's your solution. Of course with any law it has to take what? 4 years to be active...

Unfortunately, as per INA 287g, states need to be trained and approved to conduct immigration enforcement business from the federal government. The approval doesn't come from ICE but from (I believe) DOJ, and by creating their own laws they are unfortunately in violation of that.

It's time to face the reality that the Feds do not want to stop illegal immigration. Guess I should add JMO to that.

*** This article relates to the ICE directive posted on another page, which is basically a back door amnesty. No one gets deported, it seems. Even crimes are okay, unless they reach a point that is unacceptable.. murder, rape, etc, I guess.. of course then we would not deport them, either, rather we will house them in our prisons.. This is a real mess, and Obama has found a way to do it without putting anything to a vote.***
Federal judge grants request to block parts of Georgia immigration law from taking effect - The Washington Post
As I predicted, these state laws that try to let state/local officers enforce federal law will be shot down. Slowly but surely...
Doesn't make sense. If illegal immigration is "illegal", as the name implies, then it is up to local enforcement agencies to enforce the law, don't ya' think? Bank robbery is also a Federal crime. How about local authorities just ignore bank robbers, and let the Federal government deal with it? LOL.
I think I did it right. Also, here is a link you can look through that has lots of info.

And THIS is what we are up against, if anyone is interested.

The AZ leos do not have federal permission because they did not do it the legal way. That is it, there's no arguing that part. I have no problem with 287g. How about these states do it within the confines of the law?
Well I have a problem with federal laws that restrict the States in doing nothing more than enforcing the federal law that the Feds admit they don't have the resources to enforce.
How about the feds take the lead and train/certify State LE? It would help your resource numbers.
That is the goal. But the locals want to take it out of the hands of ICE and do it themselves, without training. That's why you hear ACLU screaming and crying about racial profiling, because some of these cops don't know how to check for illegal aliens other than by seeing if they have dark skin or not. I tried to get the link for you off the official ICE website, but it was 404, typical...
Here is title 8 of us code, that's immigration laws. If the link doesn't take you to it specifically, you're looking for subsection G. You will see that exactly what you are suggesting is already codified into law, but locals are overstepping their boundaries and violating this provision.
United States Code: Title 8,1357. Powers of immigration officers and employees | LII / Legal Information Institute
Permanent Nat Guard on the border. Thousands of them. With the power to enforce, not in "desk jobs" like they are now. Let the states enforce the laws, if they choose to. If not-- no whining about the end result. NO enrolling kids in school without the SAME EXACT DOCS that American kids need to enroll. Check ID in the hospital-- turn them over to BP after treatment.
PLUS-- I am all for a rule on immigration that they must be able to support themselves if they come here, no welfare. I could go on, but will stop for now.
