Emergency SOTU?

There are strong hints from the Trump camp that he may declare a "national emergency" on the southern border as soon as his SOTU speech tomorrow night.

If so, Trump would be unilaterally acting before the Congressional negotiations end on February 15 even though when his 35 day shutdown ended Trump stated he would wait until the 15th.

IMO, such a move (declaring an emergency) before Congressional negotiations end either on or before the 15th is tantamount to an intentional torpedoing of the entire negotiating process.

If Trump declares a "national emergency" tomorrow night, how could such a premature and unilateral action affect the ongoing Congressional funding negotiations?

The "negotiating process" is a joke. It needs to be dismissed. Trump needs to move on.

If he declares a national emergency during his SOTU, then Congress can pass whatever funding bill they want. Unless they get all stupid-crazy about it, Trump will sign it and life will go on.

btw, declaring a national emergency is NOT premature and it is NOT unilateral.

1. He has been describing the emergency for more than a month.

2. Nobody else is able to declare a national emergency in the manner that Trump can, therefore he isn't doing this unilaterally. He is simply exercising one of his powers as the President.

I am not entirely sure Trump would do this as part of the SOTU, but there is a high chance he will threaten doing so as a means to set the stage for the pending failed negotiations to include wall funding in the next continuing resolution.

I say that because I doubt Congressional Republicans and Democrats will agree to wall funding without Trump having to give up something like permanent DACA (and perhaps other things as well that his base would flip out about.)

In listening to all the rhetoric from both sides of the fence it seems Pelosi / Schumer are now wanting and baiting Trump to declare a national emergency.

I can only guess that they are willing to risk future abuse of executive national emergencies for any made up reason just to make it a 2020 wedge issue.

But I am already uncomfortable with all the Constitutionally questionable maneuvering going on and suspect Trump would sit back and allow the next shutdown to start before declaring the national emergency, then appealing to Twitter suggesting he is the hero in all this.

I’m predicting you will be wrong. Clinton was going to stay in office because of the uncertainty about the election, then Bush was supposed to be dictator for life then Obama was not leaving and now Trump is their for life. Someone always throws out the conspiracy theories.


IMO Trump will say he will declare emergency if no funding rather than shut down the government

He is screwed regardless . .. he isnt getting the wall money so he basically has to at least "try" to declare an emergency. He has to do something to try and make it look like it is somebody else fault. That majority of people wont be fooled anyway but thats what he is going to do.

Id guess for now though he just tries his best to paint this as not his fault and to make the situation look like some fantasy crisis. He'll quote a bunch of stats that dont really mean anything and say those against him dont care about <insert fake dramatic issue here>

The fact that the crisis hasn't been acted upon to this date doesn't mean the crisis fails the definition of "emergency". It just means the emergency still exists.

He tried to get Congress to act on the emergency. They won't. It's now time for him to leave them behind and deal with it.

Can you cite the particular laws that have provisions for a national emergency that would allow you to do that?

The crazy internet conservative argument has been that after the budget is allotted, the President can just willy-nilly shift funds from one place to another. If it works on building a wall that will take many years and many tens of billions of taxpayer dollars to complete, it will work on sooooo many liberal goodies. Open this door. Anything can be an "emergency", show us the way!

Oh please. You know darn well that the Democrats aren't going to give him one dime for a barrier, even though they let Obama build hundreds of miles. At least be honest. Do you really expect the negotiations to give Trump any barriers? Now answer honestly.

I don't place any credence in crazy internet arguments...whether they are conservative or liberal. And no, the President cannot just "willy-nilly shift funds from one place to another". Since you don't seem to know anything about the National Emergencies Act, I highly suggest you don't listen to crazy internet arguments, either.

In any case, there have been plenty of Dem Presidents declaring national emergencies. Future Dem Presidents don't need Trump to show them how to do it.
 
I think he should have a huge big screen placed right behind the speaker and VP and show the whole world without the media being able to suppress, the hypocrisy of the left in their own words. Have the real experts give their opinions, and display the facts, and the costs of NOT building the wall. The media can't hide it, they will carry it to their viewers and maybe some of them will finally get it. That's what he should do. Call it show and tell.. because American's ARE that stupid!

He also said puerto rico wasn't a real emergency like katrina. With a statement like that one has to wonder what his definition of emergency means?
