If you can understand that concept then you might understand the greater good of using an El Salvadoran prison for tattooed bad guys is more important letting out a prisoner in his own country.

I believe the president must not only adhere to the Constitution but must also decide what is the greatest good for the greatest number of people.

It would be no different because this is about due process. Can you cite which similar cases happened under the Biden administration? I don't recall there being any arrangements with foreign prisons for this kind of thing.

He was an illegal alien from sometime in 2011 to 2019.

In 2019 he was denied aslyum by Judge Jones and a deportation hold was put in place. Which made him temporarily legal until such time as the Trump Administration processed him for deportation to a 3rd party country IAW 8 USC 1231. The Trump Administration never took that action.

So temporary legal.

I agree that people to be incarcerated are entitled to due process of the law. What is the Constitutional prohibition of sending convicted criminals to a prison outside of this country? Who gets to decide?

You're right. Garcia should have been given the right of due process. He wasn't. Now someone has to figure out how to release him into his own country. Would that be a safe outcome for Garcia? And on whose authority should he be sent to another country that is not his country? Who gets to decide? Aren't you glad you're not Pam Bondi?

The Left desperately needs an issue to champion.
In 2020 they had George Floyd to warrant (and forgive) all manner of death and destruction on the streets of our cities. Maybe they can blow this one up into a Constitutional Crisis.
There's probably a team of Soros-funded lawyers working hard to come up with a legal argument not only to get Garcia back to the States but to also make Trump and AG Bondi look bad in the process.

Actually, no. The "someone" is the US government, since they deported him in error as they have openly admitted. While this whole song and dance number about the US being helpless to do anything is ludicrous, since they are the ones who sent him there and the ones paying El Salvador to detain him and others. If the US doesn't have the political clout to negotiate this with El Salvador, then I guess American diplomatic reach has hit new lows.

Now, if the US is not interested in maintaining Garcia's current immigration status, they can make that case in court after they bring him back. If he is indeed a "terrorist" as claimed by El Salvador's president, then they can try him after his immigration issue is solved in US courts. It's interesting to note that Garcia has no criminal record in El Salvador either, so how its president came to that conclusion is a mystery.

Would that be a safe outcome for Garcia?
What would be a safe outcome for Garcia is for him to be released from prison and flown back to the US. As I noted above, if the government has an actual deportation case to make, then it can do so in the courts.

Good question for this administration, since they've been sending Venezuelans to El Salvador too.

Trump needs to serve hard time for what he has done. Unlawfully deporting an innocent man is not an official act. Trump CAN and WILL be held accountable for that.

After Trump's term ends (either in 2 or 4 years...whichever comes first, factoring in a possible retake of Congress by the Democrats next year), a lot of lawyers are gonna be plenty busy.

And i wonder how many lawyers Trump will go through.....and how many of those will suffer the Trump/Lawyer version of Kirk's Enterprise/Red Shirts.

Trump is a disease that kills anything he touches. Lawyers should be intelligent enough not to do ANY business with him. Those that do need to be AUTOMATICALLY disbarred.

Well, for starters, 75% of the 238 Venezuelan migrants deported to the prison in March 2025 had no apparent U.S. or international criminal record.

If someone is okay with sending people who've committed no crime to a brutal prison, with no hope of release, I'd call that person evil. It's pure evil. There's no other word for it.


jaypatriot, these people are not getting out. All of them are going to die in that prison.

The issue the Left champions right now is the U.S. Constitution, and Due Process, in particular. You may recall, we fought a war for it, and our most significant wars since then have been to uphold the founding principles of our nation. I wonder how many of your ancestors fought and died for our freedoms today? Would they look kindly at what you're doing now, trampling over the Constitution they fought so hard to protect?

I've always considered myself a moderate, but if defending the Constitution means I am part of the Left, so be it. I'm proud of it. Call me a Leftist all day long. You want to associate me with George Soros? Does Soros love the U.S. Constitution? If he does he is my brother. The only thing I don't understand is why aren't you ashamed of being associated with a political bloc that appears intent on destroying the U.S. Constitution?
