Remember Gregoire defeating Rossi? That was from fraud.
That wasn't fraud.
The initial recount was required by Washington state law as Rossi's margin was under 2000 votes, so an automatic count was done. The count dropped his lead from 261 votes to 42 votes.
At this point, the state DNC asked for a manual recount, which can be requested as long as the party is willing to pay upfront for the manual recount. As the elections was so close, the DNC felt it was worth it, paid almost $750,000 to have the recount done. In trying to determine how the count should be done, the DNC were denied by the courts to use the universal standard.
In the process of the recount, five counties were found to have ballots that were not even counted. The DNC pushed to have them counted but the GOP tried to halt the count. As a result, the process found Gregoire ahead by 8, then later, 10 votes.
The GOP then sued to have ballots not counted in the approved legal fashion in King County, however the courts over-ruled it. The GOP then tried to sue to stop the ballot count in Pierce County which was upheld by Washington Courts....only to be overturned by the Supreme Court.
In the end, Gregoire was ahead by 129 votes. At this point, Rossi demanded a complete re-vote...not a re-count, but a whole new vote. Even the state RNC chairman said no as there is no legal clause to allow a re-vote.
There was a lawsuit brought on by the RNC after Gregoire was sworn in. The judge deemed the evidence that the RNC provided was not enough to prove how either Rossi or Gregoire could benefit from it, ordered the contests ballots eliminated from the vote tally (close to 1,700 votes) in addition to 5 more and as a result....Gregorie won by 133 votes. Rossi dropped it and finally conceded.
Gregorie won legally. I will grant you it was a mess, but the election was won fair and square just like when W beat Gore in 2000.
