Democrats Enable Frivolous Lawsuits To Rape Economy, Innovation Some More

A man is suing a drug company for making a Parkinson's drug that allegedly made him gamble away $14,000. The drug does lead to "compulsive behavior" in a small portion of the population, but the company followed all the rules, did all the testing legally necessary, and placed warning labels about this on their medication.

Remember Viox? That shut down 3 plants and killed 6,000 American jobs. Go Democrats. Eventually, trial lawyers are going to do to drug development what they did to flu vaccines-make it more of a liability than it is worth for companies to even try. There are many, many advanced drugs companies have developed for all sorts of painful, miserable diseases, but since trial lawyers are allowed to bankrupt drug companies with impunity, regardless of whether or not they did anything wrong, many of these new drugs sit on the shelves and are never released.

So my question is: Why do Democrats keep stepping in the way of any and every attempt anyone makes to reform liability laws in this country? I think the answer lies in the percentage of trial lawyers who vote for and contribute funds to Democrats. Like criminals, trial lawyers OVERWHELMINGLY (in the 90% range) vote for and contribute to those who are on their side-Democrats.

This is just another example of Democrats putting their own short term interests above the interests of everyone in mainstream America. It is also one of the many reasons I laugh when I hear Democrats claim to represent the working man.

Is this the left's strategy to force us down the road to socialized medicine: Pre-emptively annihilate all competition and innovation so that Socialism won't have anything to destroy?

At least 230 North Americans have contacted lawyers in California and Ontario about joining class actions that allege Mirapex caused them to gamble, have sex, shop and eat compulsively.

“Gambling, shopping, sexual and eating, those are the biggest four, but there’s a slew of other ones,” said Daniel Kodam, a California lawyer, about the compulsive behaviors reported.............

“People have become compulsive about knitting and painting their homes. We have people who have painted their homes 10 or 15 times over in the course of two months. ... And these are people with no history of this type of behavior.”................

The lawsuits seek compensation for the plaintiffs’ losses and punitive damages. They also want the drug companies to warn doctors and patients about the possibility of “the significant and substantial side effects” of compulsive behavior that may accompany the use of Mirapex, Kodam said.

Until this year, the drug companies didn’t warn patients that compulsive behaviors were possible side effects of Mirapex, Kodam said.

It seems to me that all drugs should require a contract acknowledging that the manufacturer is not responsible for any side effects, and you take the medication at your own risk. This would eliminate most of the lawsuits that make medicine so expensive without affecting the normal customer who just wants to be cured rather than to get rich. And if a medicine truly was dangerous? A few cases of nasty side effects would generate some terrible press, which would drastically lower the sales. Thus the incentive to make sure that medicines are safe would still exist.

Oh, and let's get rid of the FDA while we're at it. I can only think of a few government agencies more stupid than this.
