I 100% agree.

There should be a requirement that the burden of proof is on the government, that they must obtain a probable cause warrant first, must obtain a conviction, must prove ALL the money and/or property seized came from the crime/crimes of relevant to that conviction, and failing at any of that owe the person their money back, plus 10% interest, plus their attorney fees and costs of court.
Agreed that there needs to be a guilty plea or conviction and they need to show that it was obtained from profits of the illegal business...that said...drug possession needs to be decriminalized.

Oh, I believe they will be either decriminalizing or legalizing it...the writing is on the wall at how much tax revenue it provides...they need to legalize it and decriminalize the rest....and work on other forms of addressing drug issues.

Sorry, but you're suffering from delusions. Both Biden and Harris are long-time drug warriors, and there is no incentive for the federal government to legalize MJ. It's been 50 years and MJ is still a schedule 1 drug, right next to heroin.

It certainly isn't going to happen anytime soon, but it does appear that things are changing. This is how marijuana first became illegal in the US, it began with the States. California was the first State to make marijuana illegal in the 1910s. Other southern border States quickly followed suit, until more than 20 States had made marijuana illegal by the 1930s. That is when the feds stepped in and created the Bureau of Narcotics.

Federally, marijuana became a controlled substance, but it could be legally grown until 1956 if one had a federal marijuana license. In fact, after Japan invaded Malaysia in 1942 and cut off our hemp supply, the federal government issued numerous marijuana growing licenses to farmers in the mid-west.

I fully expect the States to either legalize or decriminalize marijuana first. Only after the vast majority of the States change their marijuana laws will the federal government change theirs. In the mean time, however, I think you are going to see far fewer federal marijuana busts.

It certainly won't be happening within the next 20 years, but eventually I expect to see a federal Bureau of Alcohol, Tobacco, Firearms, Explosives, and Marijuana (BATFEM).
 
Biden and Harris want the government to be able to take everything you have for itself with no due process whatsoever - just take it. That doesn't surprise any of you, does it?

Still, I think it likely every or nearly every Democrat on this forum will vote that the government should be able take anything and everything they want to from legally defenseless poor and working people who can't afford to sue the government.

That has finally ended February 2019, thanks to the Supreme Court finally getting around to incorporating the Eighth Amendment and applying to the States. It only took the Supreme Court 152 years to finally come around to that decision, but States can no longer deliberately impose excessive fines.
