SAN FRANCISCO (Reuters) - San Francisco's city attorney on Monday questioned the recent appointment of a new acting attorney general, saying in a letter to the U.S. Department of Justice that his office may take court action if the DOJ does not provide a legal justification for the designation.

President Donald Trump last week named Matthew Whitaker to replace former Attorney General Jeff Sessions, who was forced out after months of attacks by Trump for recusing himself from an ongoing probe into Russian meddling in the 2016 presidential election.

Legal move? Constitutional move? Moving to squelch Mueller probe that's hanging over DJT? We already know from video tapes that Trump knew this guy but lied about that when asked. What's the Trump agenda over the next 6 weeks?

Any neutral judge would dismiss this. Like it or not Trump has the ability/power to do what he did and he doesn't have to answer to a San Fran city attorney.

Not really. Witaker's appointment as ACTING AG. He is a place holder for a limited amount of time (7 months, longer if Trump nominates someone and the Senate takes longer to confirm) until Trump nominates someone to be the AG and the Senate confirms that person or a new one is chosen.

5 U.S. Code § 3345 - Acting officer

This is how its done every time a new President comes into Office when they "clean house".

Essentially, Dems are throwing a fit over something that they themselves have used in the past.

Again, no. The article spells out exactly why that is, coming from three different approaches, and it's most certainly not how it's done every time a new POTUS comes in. Sally Yates, for example.
