Cinemark Wants Losing Aurora Massacre Plaintiffs to Pay Legal Costs - Law Blog - WSJ

Just heard this on my local news as well

Victims and survivors of the 2012 Colorado movie theater massacre failed to convince a jury that the theater’s owner should be held responsible for the bloodshed. Now they may have to reimburse the company they sued for hundreds of thousands of dollars in legal costs.

actually this sounds
reasonable. Some of the victims were nailed with lawyers' fees when they sued the gun makers as well. Loser pays is a good idea to cut down on frivolous suits

Good. This lawsuit was BS from the get go.

That's the idea. Cinemark was clearly a victim here, the families of other victims suing them when there was clearly no cause needs to be condemned. The thing is that this could have all been avoided had the court tossed the case before trial, I am curious as to why that did not happen. If I am the judge I ask "where is the evidence that the defendant had clear warning", if there is none I toss the case, movie theaters are not hardened in our society, nor can we afford to make them so.

I think the lawyers that took this frivolous lawsuit to court should be responsible for paying the theater's legal bills.

Isn't this what Feinstein wants? To be able to sue the gun manufacturers and FFL dealers?

TORT REFORM

I want the sandy hook plaintiffs who sued the gun maker (and were allowed to continue by a slow witted left wing judge who thinks there is a question of fact whether Bushmaster/Remington is liable) to be absolutely obliterated in civil fines and penalties. The Aurora clowns who sued the gun makers have been destroyed financially IIRC. Good

had they won, it would have set a terrible precedent for future public venues of any kind

'It could have been worse" fails to work at some point, that this suit made it to court is pretty bad.

true but I see their liability as more justified as that of the gun maker. the fact that the back door was not monitored or alarmed would make it a close call if I were the trier of fact. But you are absolutely correct as to the precedent that could have been set

Absolutely. Their insurers would have seen to it that getting into a theater was the same as getting on a plane. It would take two hours to fill the theater for a two hour movie.

the thing is sometimes bizarre cases win against all odds so when people feel justified they go for the gold

I truly can not understand wanting to go through all that emotional turmoil for dollars but others obviously disagree

yes and who would want to take that risk because we all know god forbid it will happen again and again....it is the way of the world now

I saw this. I hope the theater gets their money back. People seem to need to learn a lesson the hard way along with the lawyers that convince people to file these moronic lawsuits.

well to be fair, we have always been lax about security really, we are only now learning that any public gathering is an opportunity for loons and terrorists

look at the security for the last Boston

my guy ran that marathon that was bombed...it was just too fing close to home but he still ran the next one even though the security slowed everything down to a crawl...they all ran again just to defy the fear

There is for sure a morality problem with wanting to cause pain to the other victims, and Cinemark was a victim. The moral fiber of this nation is shot to hell, has been for awhile.

well the whole world has kind of gone crazy

we are very much an "all about my own benefit" attitude presently

nothing good comes from that

Which is why I am a socialist. It is very clear which way the needle needs to move at present.

I do not understand the reasoning here. How was Cinemark negligent? Because that's what these ambulance chasers are going to have to prove.

Morales are usually based in logic and reason the same as right and wrong.

Today the agenda has been to throw out logic and reason for feelings.
When you solely base everything on feelings everything gets corrupted and then you can attempt to

the best argument was that the security was non -existent as to someone coming in the rear entrance or going out and coming back in. That is what the killer did-he went out the back, came back with weapons. an alarm on the back door might have helped but who knows

The argument was that the theater did not take proper measures to protect the people there.
It cost them a ton of money to fight it in court.

A judge tossed the case that what happened could not be predicted and the movie theater was not liable.

Now the movie theater wants the money it spent on legal fees back

Bloom was talking about this way back in the 80's in "The Closing of the American Mind". He lived just long enough to know that he got ripped to shreds for making the suggestion. This is taboo, victim culture demands that feelings are all important.

so how do we get back to that dual balance because it has to be logic but tempered with feeling

I think the lawyers involved should have to pay up every dime for duping grieving families into thinking this was a winnable case.

Same way as always, education and willpower. When the elite encourage the little people to be weak victims we tend to live down to the expectations eventually. Victim culture needs to end, and to make this happen the elite need a tune-up (GO TRUMP!). Yes I know it is a nice ego boost for them to have a bunch of victims to mind ("OH SAVE US ELITE/GOVERNMENT, WE NEED YOUR HELP SO MUCH!") but we have big problems, we have no time for this. Hook up and help pull the wagon, those who cant/wont have to be left by the side of the road to fend for themselves, till they are ready to help the collective as well as suck off of it. Maybe they die instead. THat is OK, that is part of justice.

I am Zen, NO WORK NO EAT comes easy to me.
