Am I reading her reasoning correct? The CDC failed to follow the notice and comment period and therefore the order is illegal? Do you agree with that reasoning?

I am very happy about not having to wear a mask two weeks from now when we take a long flight to Europe. Anyone on the flight can feel free to wear a mask. There is no law against it.

But the mandate exceeded the CDC statutory authority, improperly invoked the good clause exemption to notice and comment rulemaking and failed to adequately explain its decisions. Because our system does not permit agencies to act unlawfully even in the pursuit of desirable ends, the court declares unlawful and vacates the mask mandate."
