On Thursday night, the Supreme Court blocked a stringent Louisiana abortion law by a 5–4 vote, with Chief Justice John Roberts joining the liberals to keep the measure on hold. Roberts’ vote is surprising, but not a total shock: The Louisiana statute is a direct violation of the Supreme Court’s 2016 ruling in Whole Woman’s Health v. Hellerstedt, and until the court overturns that decision, the Louisiana law cannot take effect. To Roberts, this precedent matters. To Justice Brett Kavanaugh, it does not. Kavanaugh so disagreed with the majority that he wrote a dissent explaining why the Louisiana law should be allowed to move forward—an opinion that should not be taken as anything less than a declaration of war on Roe v. Wade.

You should probably have read what was going on with the case before you comment. No judgement about admitting privilege being an undue burden or not has been made yet. This was only the decision to suspend the law until such a judgement can be made

In all fairness Bush was an establishment Republican. That makes him virtually indistinguishable from your average Democratic politician. It's little wonder Roberts is drifting left already. Give him a couple of years and he'll be a full blown justice Kennedy.

Louisiana has three clinics that currently provide abortions. As relevant here, four doctors perform abortions at
those three clinics. One of those four doctors has admitting privileges at a nearby hospital, as required by
the new law. The question is whether the other three
doctors—Doe 2, Doe 5, and Doe 6—can obtain the necessary admitting privileges. If they can, then the three
clinics could continue providing abortions. And if so, then
the new law would not impose an undue burden for purposes of Whole Woman’s Health. By contrast, if the three
doctors cannot obtain admitting privileges, then one or
two of the three clinics would not be able to continue
providing abortions. If so, then even the State acknowledges that the new law might be deemed to impose an
undue burden for purposes of Whole Woman’s Health.
The law has not yet taken effect, so the case comes to us
in the context of a pre-enforcement facial challenge.

That means that the parties have offered, in essence, competing
predictions about whether those three doctors can obtain
admitting privileges. The District Court concluded that
the three doctors likely could not obtain admitting privileges. The District Court therefore enjoined the law. The
Court of Appeals for the Fifth Circuit concluded that the
three doctors likely could obtain admitting privileges. The
Fifth Circuit therefore lifted the injunction.

Kavanaugh's opinion though is spot on and agree's with the appeals court.
there is no war against roe vs wade.

the plantiffs have to offer that an undo burden exists. he even acknowledge that one would exist if the 3 doctors could
not get admitting privs to their hospitals and at that point in time could run foul of the law.

but they had 45 days to get that done before the law took affect.
again this was only a ruling on a stay not the actual law itself.

usually the courts should not rule on something unless someone can produce and actual harm.
since no harm was done and the law has not taken affect yet he was 100% right.

I see Slate, as usually, worked itself up to overwrought panic and hysteria. :roll: As I understand the issue here it was LA's requirement that a doctor performing an abortion have admitting privileges at a nearby hospital - HORROR of HORRORS. :eek:
 
His opinion is incredibly uninformed or dishonest in its hypocrisy.

The state of LA wants to demand surgical access to hospitals for abortion providers...yet no such requirements are made for mid-wives doing home births.

And abortion is 14 times safer than childbirth. (I have link on other laptop)

So unless they start changing the laws for home births and mid-wives...they are all lying hypocrites. And still suckering in the uninformed who will believe anything as long as it's what they want to hear.
