As mentioned above, the judge deciding for a generous settlement for the children is the best of both worlds for Biden. Biden has already said that payments "aren't going to happen" and that discussion of payments would only encourage illegal immigration. So it would make no sense to go to court hoping to lose in some 4d chess scheme, after telling people he won't pay, and actually refusing to pay, when he could just pay.

If the media hadn't spilled the beans about what the DOJ was planning to pay, the settlement would have happened and nobody would have known until it was a done deal.
