Yesterday we told you about a softball coach who says a Cordova church kicked her team out of their league because she is gay. A spokesman for Bellevue Baptist Church did not want to comment on the accusations, but an attorney says state and federal anti-discrimination laws would not cover Jana Jacobson’s claims.
“So far the federal and state laws have not gotten to the point of including sexual orientation as a protected class under the federal Constitution’s 14th Amendment, which is generally what is used,” explained Memphis attorney D’Army Bailey. "I would think that [Jacobson’s] best route would be civil litigation based upon contract rights.”
Jacobson said the team paid Bellevue a $350 registration fee to join the league after they learned it was open to the community.
“If these players have made an agreement with the church to provide them with an opportunity to participate and that contract was breached without good reason, then they may have recourse under our civil laws for breach of contract,” Bailey said.
He said churches are not exempt from the law.
So, the entire team may still have a route to go after that evil doer church. They wouldn't get much but, it would be a small message.
Makes sense. After all, we are talking about Tennessee.
