In a 1996 memo, Kagan suggested that the case should be taken by the Supreme Court and that the justices should side with the landlady, who refused to rent to unmarried couples. The memo is part of a roughly 40,000-page trove of documents released Friday that shed more light on what kind of justice Kagan might be.

The papers also reveal that Kagan helped draft an executive order detailing federal employees' rights to express their religion in the workplace.

Not quite the type of person some on the right are portraying. She is definitely liberal, but not far left across the board.
 
It would seem Kegan is socially and politically liberal, but she is more of a classic liberal. Typically there are two roots behind being socially liberal. One is "the government has no right to legislate social morality, thus things like abortion, gay marriage, and prostitution should be legal." Others seem to have the root that "there is nothing wrong with gay marriage, abortion, and prostitution, the government should legalize and support them because my morals hold that they are not wrong." Basically, the first is from a root of less government intervention into social/moral issues. The latter would be more government intervention by supporting a moral code that one holds. I would say the first is more like classic liberalism.

That being said, I believe Kagan is a classical liberal when it comes to social issues as she clearly supports the personal rights of a woman who wants to prevent unwed couples from renting her property. This would suggest the stance that Kagan simply wants government to stay out of social issues, not that she is asserting her social/moral views on others. No one has to agree with my first paragraph about the roots of social liberalism (and I'm sure many would find them bogus), but I do believe that Kagan is socially liberal because she wants government to respect personal moral choices. I would have to side with Kagan on her opinion as well regarding this case.

Not sure if you are aware of it, but it is certainly interesting how you put those three issues together...

I don't really see what you are trying to get at. I just picked three social issues at random that most liberals seem to support legality of. It was for pure illustrative purposes only.

Not sure why supporting free speech in this instance is not a liberal value.

I probably should have specified "as the right views it". We are seen as being hostile to religion, which is not true or accurate. Kagan has proven to not be hostile to religion.

No you see liberals only hate Christianity and they love Muslimism and terrorists.
