Mylan and the Epipen. Purdue and Oxycontin, they extended their patent for Oxycontin by essentially re-releasing a child's version. It is all the same abuse of patent law. The whole pharmaceutical industry is guilty of abusing patent law. Just like the entertainment industry abuses copyright.

Mylan is primarily a generic house.

Perdue is despicable for other reasons and patent extensions for pediatric use is a good program that really benefits pediatric patients.

Patent law is complicated, and abuse is really subjective. You can’t fault businesses for trying to use patent law to their own advantage.

But subverting the Orphan Drug act like this is blatantly wrong, and the FDA needs to step in ASAP.
 
It happened again.

A tiny pharma company took an old, established, dirt cheap generic drug and did a few easy clinical trials to get market exclusivity with it, and have driven the price from dirt cheap to $375,000.

This is a problem, and the FDA needs to address it ASAP.

And please don’t confuse this company with big pharma, the companies that are innovating new molecules.

Generally these things shake out with a simple rule that generic forms of a drug should be made available whenever possible. There will still be those who prefer the brand name drugs to keep big pharma (or little pharma) going and the developer of any drug deserves his pay and perhaps a short term patent so that it can recoup the considerable expense to develop the drug along with a reasonable profit.

But our current President is interested in solving problems involving prescription drugs and, unless his opposition is successful in completing hamstringing him, I figure he will accomplish some good things there just as he is in so many other areas.
