AG Garland: States can't ban FDA-approved abortion pills on safety grounds

Attorney General Merrick Garland said in a statement Friday, in the wake of the Supreme Court's decision to overturn Roe v. Wade, that states cannot ban mifepristone, a medication that is used to bring about an abortion, based on disagreement with the federal government on its safety and efficacy.

Why it matters: With Roe overturned, prescribed drugs that terminate pregnancies are likely to become the next major contention between abortion rights activists and opponents of abortion rights.

How it works: Mifepristone and misoprostol have been approved by the Food and Drug Administration for use in the first 10 weeks of pregnancy.

But they will try very hard. Along with same-sex marriage etc.
 
That's good. The FDA has approved the medicine for the entire country. And the USPS can deliver it anywhere in the country. The next step is to make sure that it's either available without a prescription for delivery, or make sure it's prescribable via telehealth with out of state doctors.
 
If it's not a crime to have an abortion, what would the grounds be to ban the pills? (Somewhat tongue-in-cheek)

But so far, no states have criminalized having an abortion, only providers and 'abettors.' So what will the state claim? And if they come from out of state, the state cant take legal action or sue (well they can try but the providers are private companies and the prosecuting state needs cooperation from the other state to bring charges.)

At the moment, there are blue states preparing legislation that protects private companies and clinics from that kind of out of state harassment.

It's interstate commerce. Therefore the federal government has the right to protect it.

If someone is on the fence about a pregnancy, she probably will be more careful now.

Look how women have often pretended to be pregnant in the past to trap men into marriage? They lied then, they can just claim to have lied about a real pregnancy...there's no proof, no documentation, no need for Dr visit or record.

And in a criminal case, or even a civil law suit, there does need to be real proof of the pregnancy and the procedure. If there's no proof of the pregnancy, she could have gone to an out of state clinic for birth control pills. 🤷 And her "accomplices" then were only helping her get birth control.
