77 year old man dies from injuries sustained from police actions after speeding 13 miles

77 year old Ralph Ennis, from Pennsylvania was speeding, he drove 63 in a 50 mile zone. The police stopped him and 13 days later the man was dead. Well, between the stop and his death some things happened and the only reason we know this is because of one corporal who did not tow the thin blue Omerta line if silence.

The 77 year old parked his car, got out with his hands by his sides not posing a threat to anybody when one officer slammed him face first into his car and then the victim was taken by a second officer and they slammed/fell to the ground. The 77 year old who had been the subject of a silver alert just before this incident due to him having dementia and having been missing.

After the man was taken to hospital he was starting to show signs of a bleed of the brain, he was transported to another hospital but died 13 days after his police interaction.

For this one elderly man there were at least 5 officers at the scene, a canine officer and the only honest police officer on the scene, was saying when he got to his car (filmed luckily) "That was … unjust and … un[expletive] called for."

Then the police started lying because this is the account of the sheriffs office:

Ennis exited the truck following deputies’ commands, but refused to drop his keys. In the original release, the sheriff’s office said a deputy came from behind, grabbed Ennis’ arms to control him and “escorted” him to the back of the truck.

“While attempting to restrain Mr. Ennis, two deputies and Ennis fell over the protruding trailer hitch of his pickup truck,”

Ennis sustained two non-life-threatening injuries — a cut to the ring finger of his right hand caused by the jagged edge of his truck tailgate and a cut above his right brow near his forehead. The sheriff’s office said deputies provided treatment at the scene, and Ennis was transported to Warren Memorial Hospital.

This is the account of the front Royal Officer who said it was unjust and uncalled for:

“I arrived on scene and I observed a male open the driver side door of the Ford F150 and exit the vehicle with his arms down by his side. … Another Deputy ran behind the male and placed his arms behind his back and jerked the male around toward the Ford 150. The Deputy slammed the male into the camper top face first. I observed the male spit something out on the pavement just below his body. Another Deputy came from the side of the male and grabbed the male while the other Deputy had his hands behind his back. The male was pushed over but his legs had caught the hitch on the back of the truck. Two deputies and the male were on the ground at this point.”

Do that to an old man and see whether you face the death penalty.

It is not just a "few" bad apples. They would not feel authorized to behave this way if they were not authorized to behave this way. Police-citizen interactions should not be worse than soldier-foreign-civilian interactions in, say, Iraq or Afghanistan.
 
Let's see the usual suspects defend this.
The guy was an unarmed pensioner who had mostly complied and he was treated like he was OBL.

If they can justify that then all is lost and they can justify any police action.

Not dropping your keys should not end in a fatality. It's as simple as that.

He reported the truth when the sheriff lied about what had gone down. So he already witnessed what had happened.

So what’s your point? That if you find one legitimate case of excessive force that the dozens of lies about American police you read and repeat on a regular basis are correct?

There’s a prima facie case for using force, it looks like bad tactics and very poor judgement, I’m not sure this by necessity constitutes a crime. If this was a non police event than it would either be straight up assault, which leading to death makes it murder, but I really doubt it would lead to a capital murder case with death sentence imposed, if it was a use of force by a security guard or shopkeeper which was execessive and resulted in death it would likely go to manslaughter, and a death penalty would not be imposed.

When it’s police though, there’s a case where someone didn’t respond to an attempt to pull him over, which means already now the encounter is not about speeding, it becomes about fleeing police, he then stops, he gets out, he’s not following lawful commands, which means he can be subject to force to make him follow commands. If you’re going to argue this was murder you need to necessarily argue that sufficient cause didn’t exist for even an investigatory detention. If you’re going to argue manslaughter than you would need to argue recklessness in actions. I’m not sure that exists.

Now I know the next argument “he was an old man, he had dementia! He shouldn’t have been subjected to this!” Ok, but that’s now a best practices argument, under black letter reading of the law he’s a resisting suspect. If he were arrested for resisting the DA would drop it by arraignment, but it would still be a valid arrest. Clearly they used much more force than was necessary, but it’s not clear to me it would be illegal.

If you’re part of a foreign occupying military force you have no actual obligation to enforce the law upon the occupied population, except as needed to secure your operations against partisans and sabetours and ensure sufficient order for civilian functioning.

General law and order is still supposed to be carried out by the occupied county’s own police forces. As was the case in Georgia in 2008 where Georgian police forces, although minus their firearms, still operated their normal duties in areas occupied by Russia.

Soldiers don’t need to enforce things like traffic rules or bar fights or domestic violence, or stabbings, or anything like what police deal with. Occupying soldiers can simply ignore that stuff. Domestic police forces have to be able to make arrests using escalating force for non compliance if they decide someone is going to jail or at least is not free to leave pending investigation

I counted at least 6 cruisers. There's something more going on here than 13 miles over the speed limit.
